【摘要】：環(huán)境法的基本理念與原則是體現(xiàn)環(huán)境法有別于其他部門法的獨特性所不可或缺的,具有一定的方向引導性和行為準則性。在國際環(huán)境法、歐洲環(huán)境法中,環(huán)境法的基本理念與原則包括可持續(xù)發(fā)展、未然防止及預防、原因者負擔等等。除此之外,環(huán)境權(quán)雖被稱作權(quán)利,但也具有與理念、原則類似的性質(zhì)。日本的《環(huán)境基本法》把可持續(xù)發(fā)展視作經(jīng)濟、社會、環(huán)境協(xié)調(diào)統(tǒng)一的支柱,但沒有體現(xiàn)其作為原則的行為準則性;對預防原則和環(huán)境權(quán)沒有明文規(guī)定;對原因者負擔原則只做了有限的規(guī)定。鑒于這些理念與原則在環(huán)境法中的重要性,今后修改《環(huán)境基本法》時應當加以明確。
[Abstract]:The basic concepts and principles of environmental law are indispensable to embody the uniqueness of environmental law which is different from other branch laws. It has certain direction guidance and code of conduct. In international environmental law and European environmental law, the basic concepts and principles of environmental law include sustainable development, preemptive prevention and prevention, burden of cause and so on. In addition, environmental rights are called rights, but they are similar to ideas and principles. The basic Law on the Environment of Japan regards sustainable development as the pillar of economic, social and environmental coordination and unification, but does not embody its standard of conduct as a principle, and has no explicit provisions on the principle of prevention and the right to environment. The principle of the burden of the cause is limited. In view of the importance of these concepts and principles in environmental law, it should be made clear when amending the basic Law of the Environment in the future.
