【摘要】：目前患者的知情同意權(quán)不斷與其他權(quán)利產(chǎn)生沖突,權(quán)利沖突的本質(zhì)是價值訴求或利益的沖突。這種沖突主要表現(xiàn)在:患者知情同意權(quán)與患者生命健康權(quán)的沖突;患者知情同意權(quán)與醫(yī)方特殊干預(yù)權(quán)的沖突;患者知情同意權(quán)與醫(yī)方保護(hù)性醫(yī)療的沖突;患者知情同意權(quán)與患者隱私權(quán)的沖突;患者知情同意權(quán)與社會公共利益的沖突。解決這些沖突的法律途徑有:立法上的途徑:權(quán)利配置;司法上的途徑:利益衡平;守法上的途徑:法律的遵守。
[Abstract]:At present, the patient's right of informed consent is in conflict with other rights, and the essence of the conflict of rights is the conflict of value or interest. This kind of conflict is mainly manifested in: the conflict between patient's informed consent right and patient's right to life and health, the conflict between patient's informed consent right and the doctor's special intervention right, the conflict between patient's informed consent right and the patient's protective medical treatment. The conflict between patient's right of informed consent and patient's right of privacy, and the conflict between patient's right of informed consent and social public interest. The legal approaches to resolve these conflicts are: legislative approach: right allocation; judicial approach: benefit balance; law-abiding approach: law compliance.
