【摘要】：環(huán)境質(zhì)量標(biāo)準(zhǔn)是界定環(huán)境是否受到某種污染的各類限值,離開一定的環(huán)境質(zhì)量標(biāo)準(zhǔn),環(huán)境是否受到污染在大多數(shù)情況下將難以判斷。在存在環(huán)境質(zhì)量標(biāo)準(zhǔn)且其自身的合法性和合理性未受質(zhì)疑的前提下,應(yīng)當(dāng)承認(rèn)環(huán)境質(zhì)量標(biāo)準(zhǔn)在侵權(quán)法上界定是否存在污染的效力,從而承認(rèn)被告的合規(guī)抗辯。如果環(huán)境中的特定污染物沒有超過環(huán)境質(zhì)量標(biāo)準(zhǔn)規(guī)定的限值,無論排污者排放的污染物是否超過了污染物排放標(biāo)準(zhǔn),排污者都不應(yīng)承擔(dān)環(huán)境污染侵權(quán)責(zé)任。如果環(huán)境中的特定污染物超過了環(huán)境質(zhì)量標(biāo)準(zhǔn)規(guī)定的限值,該污染物系排污者的排放所致,且能夠認(rèn)定污染物與損害結(jié)果之間存在因果關(guān)系,則排污者應(yīng)當(dāng)承擔(dān)環(huán)境污染侵權(quán)責(zé)任。當(dāng)不同地方的環(huán)境質(zhì)量標(biāo)準(zhǔn)對同一污染物限值的規(guī)定不一致時(shí),應(yīng)當(dāng)以更加嚴(yán)格的環(huán)境質(zhì)量標(biāo)準(zhǔn)為進(jìn)一步判斷人身損害因果關(guān)系是否存在的"門檻":當(dāng)污染物超過更加嚴(yán)格的環(huán)境質(zhì)量標(biāo)準(zhǔn)限值時(shí),則進(jìn)入判斷因果關(guān)系的程序,否則,排污者不承擔(dān)環(huán)境污染侵權(quán)責(zé)任。環(huán)境質(zhì)量標(biāo)準(zhǔn)是判斷環(huán)境侵權(quán)因果關(guān)系是否具備相當(dāng)性的合理界限,從而也是利益是否受侵權(quán)法保護(hù)的邊界。
[Abstract]:Environmental quality standard is a kind of limit value that defines whether the environment is polluted or not. It is difficult to judge whether the environment is polluted or not without a certain environmental quality standard. On the premise that there is an environmental quality standard and its legitimacy and rationality are not questioned, it should be recognized that the environmental quality standard has the effect of defining whether there is pollution in the tort law, and thus the defendant's compliance defense should be recognized. If the specific pollutant in the environment does not exceed the limit stipulated by the environmental quality standard, no matter whether the pollutant discharged by the polluter exceeds the pollutant discharge standard, the polluter shall not be liable for environmental pollution infringement. If a particular pollutant in the environment exceeds the limit specified in the environmental quality standard, the pollutant is due to the discharge of the polluter and the causal relationship between the pollutant and the result of the damage can be determined, The polluter shall bear the tort liability for environmental pollution. When the environmental quality standards in different places do not agree with the limits of the same pollutant, Stricter environmental quality standards should be used as the "threshold" to further determine the existence of causality of personal injury: when pollutants exceed the limits of more stringent environmental quality standards, the procedure for determining causality should be entered, otherwise, Polluters are not liable for environmental pollution infringement. The standard of environmental quality is the reasonable limit to judge whether the causality of environmental tort is adequate, and thus the boundary of whether the interests are protected by tort law.
