【摘要】：修復(fù)生態(tài)環(huán)境責(zé)任在實(shí)踐中面臨兩大難題:一是生態(tài)環(huán)境損害難以認(rèn)定;二是修復(fù)的裁判要求難以達(dá)到妥當(dāng)程度。對(duì)此,需結(jié)合法律規(guī)范和司法判決,對(duì)"生態(tài)環(huán)境損害"和"修復(fù)"進(jìn)行解析。對(duì)生態(tài)環(huán)境損害的認(rèn)識(shí)應(yīng)在兩方面展開:一是損害是生態(tài)環(huán)境的物理、化學(xué)、生物特性的不利改變以及提供生態(tài)系統(tǒng)服務(wù)能力的破壞、損傷;二是損害應(yīng)可評(píng)估�；谛迯�(fù)范圍、標(biāo)準(zhǔn)、方式、方案的限定和篩選,裁判中的修復(fù)要求應(yīng)作出盡可能精確的妥當(dāng)表達(dá)。"修復(fù)生態(tài)環(huán)境"與民法中的"恢復(fù)原狀"存在很大差異,在救濟(jì)對(duì)象、標(biāo)準(zhǔn)、方式等方面兩者無法相提并論。民法總則未將"修復(fù)生態(tài)環(huán)境"納入民事責(zé)任承擔(dān)方式,是科學(xué)、妥當(dāng)?shù)陌才拧?br/>[Abstract]:In practice, the responsibility of repairing the ecological environment is faced with two major difficulties: one is that the damage to the ecological environment is difficult to determine; the other is that the judicial requirements of the restoration are difficult to reach the appropriate level. Therefore, it is necessary to analyze the damage to the ecological environment and the restoration of the ecological environment in combination with the legal norms and judicial decisions. The understanding of ecological environmental damage should be carried out in two aspects: one is the adverse change of the physical, chemical and biological characteristics of the ecological environment and the damage of the ability to provide ecosystem services, the other is that the damage should be evaluated. "based on the scope, criteria, methods, limitations and selection of the scheme, the repair requirements in the referee shall be expressed as accurately and appropriately as possible." There is a great difference between the restoration of ecological environment and the restoration of the original state in the civil law, which can not be compared in terms of relief objects, standards, ways and so on. It is a scientific and proper arrangement that the general principles of civil law do not include the restoration of ecological environment in the way of civil liability.
