【摘要】：臺(tái)兒莊位于山東省南部的棗莊市,作為一個(gè)包含臺(tái)兒莊古城、京杭大運(yùn)河臺(tái)兒莊區(qū)段以及二戰(zhàn)遺址的歷史文化名城,在由“賣資源”向“賣文化”、“賣創(chuàng)意”轉(zhuǎn)型的過程中,進(jìn)一步加強(qiáng)古城的法律保護(hù)勢(shì)在必行。在臺(tái)兒莊古城的保護(hù)上,雖然,棗莊市人大常委會(huì)于2013年11月出臺(tái)了《山東省臺(tái)兒莊古城保護(hù)管理?xiàng)l例》,但在相關(guān)配套規(guī)定及可操作性方面仍舊還不很完善。并且,在當(dāng)前公眾對(duì)文化遺產(chǎn)保護(hù)意識(shí)還相對(duì)薄弱的情況下,通過法律保護(hù),既能為古城規(guī)劃實(shí)施和規(guī)范管理提供法律依據(jù)和保障,也能避免因過度商業(yè)化開發(fā)給文化遺產(chǎn)帶來的人為破壞,對(duì)于創(chuàng)新文化遺產(chǎn)保護(hù)模式、探索文化產(chǎn)業(yè)發(fā)展道路,具有重要的現(xiàn)實(shí)意義。 本文從臺(tái)兒莊古城法律保護(hù)入手,通過個(gè)案分析法、比較法及綜合分析法等多種研究方法,結(jié)合社會(huì)學(xué)、歷史學(xué)、經(jīng)濟(jì)學(xué)及法學(xué)理論等多個(gè)角度對(duì)古城法律保護(hù)的必要性進(jìn)行分析,發(fā)現(xiàn)目前臺(tái)兒莊古城法律保護(hù)方面存在法律原則缺乏明確性,可操作性差,保護(hù)資金來源渠道缺乏法定性及公眾參與程度低且無法律依據(jù)等不足。并與日本、法國(guó)、英國(guó)、意大利等國(guó)家古城法律保護(hù)加以比較,學(xué)習(xí)與借鑒他們法律保護(hù)方面的成功經(jīng)驗(yàn)。在法律制度建設(shè)方面：明確古城法律保護(hù)原則及保護(hù)對(duì)象,將非物質(zhì)文化傳統(tǒng)納入古城保護(hù)范圍；完善責(zé)任追究機(jī)制,使對(duì)于古城破壞行為的懲罰具體化、量刑準(zhǔn)確化。在古城保護(hù)行政管理體制方面：在保留目前雙層管理體制的前提下,學(xué)習(xí)意大利“文物監(jiān)管人”制度,以克服管理程序繁瑣所帶來的行政效率低下的弊端。在保護(hù)規(guī)劃方面：盡力做到事前規(guī)劃,使規(guī)劃真正發(fā)揮指導(dǎo)作用,而非流于形式。在資金投入方面：借鑒日本、英國(guó)、意大利等國(guó)的做法,將投入資金比例法定化,從政府撥款、公眾募捐、文化產(chǎn)業(yè)等多種渠道為古城保護(hù)籌集資金。在公眾參與方面：疏通公眾參與渠道,充分發(fā)揮古城保護(hù)民間組織力量,使古城保護(hù)成為一種人民自覺行為。 筆者希望通過本文的研究,可以引起國(guó)內(nèi)各地方對(duì)于古城法律保護(hù)的關(guān)注,特別是為臺(tái)兒莊古城今后發(fā)展中法律保護(hù)提供具體、可行性建議。
[Abstract]:Taierzhuang is located in Zaozhuang City in the south of Shandong Province. As a famous historical and cultural city including the ancient city of Taierzhuang, the section of the Grand Canal in Beijing and Hangzhou and the ruins of World War II, it is in the process of transforming from "selling resources" to "selling culture" and "selling creativity". It is imperative to further strengthen the legal protection of the ancient city. In the protection of the ancient city of Taierzhuang, although the standing Committee of the people's Congress of Zaozhuang City promulgated the regulations on Protection and Management of the Ancient City of Taierzhuang in Shandong Province in November 2013, the relevant supporting regulations and operational aspects are still not perfect. Moreover, under the condition that the public's awareness of cultural heritage protection is relatively weak, legal protection can not only provide the legal basis and guarantee for the planning and implementation of the ancient city, but also for the normative management of the ancient city. It can also avoid the artificial destruction of cultural heritage caused by excessive commercial development, which is of great practical significance for innovating the mode of cultural heritage protection and exploring the way of cultural industry development. This article starts with the legal protection of Taierzhuang ancient city, through case analysis, comparative law and comprehensive analysis and other research methods, combined with sociology, history, The necessity of legal protection in ancient city is analyzed from economics and legal theory. It is found that the legal principle of legal protection in Taierzhuang is lack of clarity and operability is poor. Lack of legal qualification and lack of public participation and lack of legal basis to protect the sources of funds. And compared with Japan, France, Britain, Italy and other countries in the legal protection of ancient cities, learn and learn from their successful experience in legal protection. In the aspect of legal system construction: make clear the legal protection principle and object of ancient city, bring the immaterial cultural tradition into the scope of ancient city protection, perfect the responsibility investigation mechanism, make the punishment of the destruction of ancient city concrete and the sentencing accurate. In the aspect of ancient city protection administration system: on the premise of retaining the current two-tier management system, we should study the Italian "cultural relic supervisor" system in order to overcome the drawback of low administrative efficiency caused by cumbersome management procedures. In the aspect of protection planning: try to plan beforehand so that it can play a guiding role rather than a mere formality. In terms of capital investment: learn from the practices of Japan, Britain, Italy and other countries, the proportion of investment will be legalized, from government funds, public donations, cultural industry and other channels to raise funds for the protection of ancient cities. In the aspect of public participation: dredge the channels of public participation, give full play to the power of protecting the civil organizations in ancient cities, and make the protection of ancient cities become a kind of conscious behavior of the people. The author hopes that through the study of this article, it can arouse the attention of all the places in China to the legal protection of the ancient city, especially to provide concrete and feasible suggestions for the legal protection in the future development of the ancient city of Taierzhuang.
