【摘要】：[目的]我國農(nóng)業(yè)面源污染形勢日趨嚴峻,嚴重影響產(chǎn)地環(huán)境和農(nóng)產(chǎn)品供給與質(zhì)量安全,進而影響農(nóng)業(yè)供給側(cè)結(jié)構(gòu)性改革的順利進行,必須加快推進農(nóng)業(yè)面源污染防治,而健全的法律體系是農(nóng)業(yè)面源污染防治順利進行的基本保障。為適應(yīng)農(nóng)業(yè)供給側(cè)結(jié)構(gòu)性改革的要求,滿足市場對安全、優(yōu)質(zhì)農(nóng)產(chǎn)品的需求,健全完善我國農(nóng)業(yè)面源污染防治法律體系。[方法]在系統(tǒng)梳理分析我國農(nóng)業(yè)面源污染防治已有法律法規(guī)的基礎(chǔ)上,深入剖析了當前農(nóng)業(yè)面源污染防治法律體系存在的問題。[結(jié)果]法律體系建設(shè)滯后、立法質(zhì)量不高、部分法律法規(guī)缺乏可操作性、法律配套體系不完善等。[結(jié)論]針對問題,從健全法律體系、推進地方完善規(guī)章制度、明確部門職責(zé)、強化立法宣傳、完善配套體系等方面提出了政策建議。
[Abstract]:[objective] the situation of agricultural non-point source pollution in China is becoming more and more serious, which seriously affects the environment of producing areas and the supply and quality safety of agricultural products, and then affects the smooth progress of structural reform on the supply side of agriculture. Therefore, it is necessary to speed up the prevention and control of agricultural non-point source pollution. A sound legal system is the basic guarantee for the prevention and control of agricultural non-point source pollution. In order to meet the demand of agricultural supply-side structural reform, meet the market demand for safe and high-quality agricultural products, improve the agricultural non-point source pollution prevention and control legal system in China. [methods] on the basis of systematic analysis of the existing laws and regulations of agricultural non-point source pollution prevention in China, the problems existing in the current legal system of agricultural non-point source pollution prevention and control were deeply analyzed. Results: the construction of legal system lags behind, the quality of legislation is not high, some laws and regulations lack of maneuverability, and the supporting system of law is not perfect. [conclusion] in view of the problems, this paper puts forward some policy suggestions from the aspects of perfecting the legal system, promoting the local rules and regulations, clarifying the responsibility of the departments, strengthening the propaganda of legislation, perfecting the supporting system, and so on.
