【摘要】：隨著大數(shù)據(jù)技術(shù)不斷創(chuàng)新,數(shù)據(jù)的應(yīng)用領(lǐng)域也在不斷拓寬,從最初的商業(yè)領(lǐng)域延伸至公共服務(wù)領(lǐng)域、醫(yī)學領(lǐng)域等,大數(shù)據(jù)的價值日益為社會主體甚至國家所重視。在此背景下大數(shù)據(jù)產(chǎn)業(yè),也得以迅猛發(fā)展。數(shù)據(jù)交易是作為大數(shù)據(jù)產(chǎn)業(yè)的一環(huán),是衡量大數(shù)據(jù)產(chǎn)業(yè)發(fā)展狀況的主要標準,也是實現(xiàn)數(shù)據(jù)價值的關(guān)鍵環(huán)節(jié)。目前,關(guān)于數(shù)據(jù)交易的相關(guān)規(guī)范尚無統(tǒng)一的立法,而是散見于各地方的政府規(guī)章,且規(guī)定得較為原則。數(shù)據(jù)交易立法的現(xiàn)狀,導致數(shù)據(jù)交易中雖存在諸多問題,卻難以有效地解決,嚴重制約了大數(shù)據(jù)產(chǎn)業(yè)的發(fā)展。本文主要通過討論大數(shù)據(jù)產(chǎn)業(yè)中數(shù)據(jù)交易這一環(huán)節(jié),發(fā)現(xiàn)其存在的諸多問題,再一一對應(yīng)提出解決方案,尋找我國大數(shù)據(jù)產(chǎn)業(yè)順利發(fā)展的途徑。本文第一章是對數(shù)據(jù)交易的基本概述。本章首先對大數(shù)據(jù)的內(nèi)涵進行了界定,對大數(shù)據(jù)與相近似概念粒數(shù)據(jù)和信息進行了比較,分析大數(shù)據(jù)與兩者之間的同異之處和對大數(shù)據(jù)的價值進行了闡述。其次,本章論述了數(shù)據(jù)交易的基本內(nèi)容,包括數(shù)據(jù)交易的概念、數(shù)據(jù)交易產(chǎn)生的背景、數(shù)據(jù)交易的法律關(guān)系和數(shù)據(jù)交易的方式四個方面的內(nèi)容。本文第二章主要是針對中美數(shù)據(jù)交易現(xiàn)狀進行比較分析。從數(shù)據(jù)交易類型、大數(shù)據(jù)數(shù)據(jù)源、數(shù)據(jù)交易現(xiàn)狀和大數(shù)據(jù)立法四個方面對中美兩國的數(shù)據(jù)交易現(xiàn)狀先進行較為詳細的分析,在對兩者的數(shù)據(jù)交易現(xiàn)狀進行評析。本文第三章主要論述數(shù)據(jù)交易中存在的問題,包括法律制度層面的問題和數(shù)據(jù)交易實踐中存在的問題。法律制度層面的問題包括:個人數(shù)據(jù)所有權(quán)歸屬問題、數(shù)據(jù)交易主體責任不清、敏感數(shù)據(jù)清洗規(guī)則不健全、數(shù)據(jù)交易范圍不明確和數(shù)據(jù)交易監(jiān)管規(guī)范不完善五個方面。數(shù)據(jù)交易實踐存在的問題包括:大數(shù)據(jù)市場機制問題、數(shù)據(jù)交易壟斷問題和非法數(shù)據(jù)交易問題三個方面。本文第四章是針對數(shù)據(jù)交易中存在的問題提出解決建議。法律層面的問題的解決分為:明確數(shù)據(jù)所有權(quán)主體、明晰數(shù)據(jù)交易主體責任、完善敏感數(shù)據(jù)清洗規(guī)則、界定數(shù)據(jù)交易范圍和完善數(shù)據(jù)交易監(jiān)管機制。實踐層面問題的解決:數(shù)據(jù)個人交易市場的開放和數(shù)據(jù)二級交易市場的建立、對數(shù)據(jù)權(quán)主體的權(quán)利進行限制和規(guī)制非法數(shù)據(jù)交易。
[Abstract]:With the constant innovation of big data's technology, the application field of data is also widening. From the initial commercial field to the public service field, medical field and so on, big data's value is paid more and more attention to by the society main body and even the country day by day.Under this background, big data industry, also can swift and violent development.Data transaction, as a link of big data industry, is the main standard to measure the industrial development of big data, and also the key link to realize the data value.At present, there is no uniform legislation about data transaction, but scattered in the local government regulations, and the provisions are more principled.The current situation of data transaction legislation, although there are many problems in data transaction, it is difficult to solve effectively, which seriously restricts the development of big data industry.This paper mainly discusses the link of data transaction in big data industry, finds out its many problems, and then puts forward a corresponding solution to find the way of the smooth development of the big data industry in our country.The first chapter of this paper is the basic overview of data transactions.In this chapter, the connotation of big data is defined, and then the data and information of big data are compared, the similarities and differences between big data and the two are analyzed, and the value of big data is expounded.Secondly, this chapter discusses the basic content of data transaction, including the concept of data transaction, the background of data transaction, the legal relationship of data transaction and the way of data transaction.The second chapter is mainly to compare and analyze the current situation of data transaction between China and the United States.From four aspects of data transaction type, big data data source, data transaction status and big data legislation, the paper makes a detailed analysis of the data transaction status of China and the United States, and comments on the data transaction status of the two countries.The third chapter mainly discusses the problems existing in the data transaction, including the problems in the legal system and the problems in the practice of data transaction.The problems of legal system include: ownership of personal data, unclear responsibility of data transaction subject, imperfect rules of sensitive data cleaning, unclear scope of data transaction and imperfect supervision and regulation of data transaction.The problems in data transaction practice include: big data market mechanism, data transaction monopoly and illegal data transaction.The fourth chapter is to put forward some suggestions to solve the problems in data transaction.The legal aspects of the problem can be divided into: defining the subject of data ownership, clarifying the responsibility of the subject of data transaction, perfecting the rules of cleaning sensitive data, defining the scope of data transaction and perfecting the supervision mechanism of data transaction.To solve the practical problems: the opening of the data personal transaction market and the establishment of the data secondary trading market, the rights of the subject of data rights are restricted and illegal data transactions are regulated.
