【摘要】：中醫(yī)師執(zhí)業(yè)準(zhǔn)入制度是現(xiàn)代衛(wèi)生行政管理制度發(fā)展的產(chǎn)物。本文從法學(xué)視角將傳統(tǒng)時(shí)期中醫(yī)執(zhí)業(yè)模式與近現(xiàn)代以來(lái)確立的中醫(yī)師執(zhí)業(yè)準(zhǔn)入制度進(jìn)行對(duì)比,論述了不同時(shí)期中醫(yī)師執(zhí)業(yè)的法律制度,分析了不同時(shí)期中醫(yī)師執(zhí)業(yè)制度的利弊,并客觀評(píng)價(jià)了當(dāng)前我國(guó)的中醫(yī)師執(zhí)業(yè)準(zhǔn)入制度,指出我國(guó)現(xiàn)行醫(yī)師執(zhí)業(yè)準(zhǔn)入制度并不完全適合中醫(yī)執(zhí)業(yè)群體的實(shí)際情況和現(xiàn)實(shí)發(fā)展需要,新的中醫(yī)藥立法應(yīng)汲取傳統(tǒng)中醫(yī)師執(zhí)業(yè)準(zhǔn)入的特色,結(jié)合現(xiàn)代中醫(yī)發(fā)展的現(xiàn)實(shí)需要,制定一套獨(dú)立于西醫(yī)話語(yǔ)權(quán)之外的中醫(yī)師執(zhí)業(yè)準(zhǔn)入制度。
[Abstract]:The admission system of traditional Chinese medicine practitioners is the product of the development of modern health administration system.From the perspective of law, this paper compares the traditional Chinese medicine practice mode with the admission system established since modern times, discusses the legal system of Chinese medicine practitioners in different periods, and analyzes the advantages and disadvantages of the practice system of Chinese medicine practitioners in different periods.It also objectively evaluates the current access system of TCM practitioners in our country, and points out that the current admission system is not fully suitable for the actual situation and the actual development needs of TCM practitioners.The new legislation of traditional Chinese medicine should draw on the characteristics of traditional Chinese medicine practitioners' access to practice, combine with the practical needs of the development of modern Chinese medicine, and formulate a set of admission system of Chinese medicine practitioners independent of the right of western medicine to speak.
