我國《學(xué)校教育法》為何難以制定

【摘要】:《學(xué)校教育法》是關(guān)乎所有學(xué)校及學(xué)校事業(yè)的實(shí)體法。由于我國長期以來在認(rèn)識(shí)層面存在理解誤區(qū),加上地區(qū)差異性大以及沒有很好厘清《學(xué)校教育法》與其他教育法律之間的關(guān)系等原因,國家層面的《學(xué)校教育法》遲遲未能出臺(tái),由此不僅造成了國家教育法律體系的嚴(yán)重失衡、教育微觀層面多方關(guān)系的權(quán)責(zé)不清、學(xué)校內(nèi)部治理的無法可依,同時(shí)也造成了學(xué)生本應(yīng)享有的基本權(quán)益被隱性掩蓋等諸多問題與弊端的出現(xiàn)。通過對(duì)呼吁立法的現(xiàn)實(shí)狀況進(jìn)行梳理,提出《學(xué)校教育法》的制定應(yīng)明確各級(jí)各類學(xué)校的性質(zhì)、界定校長的法律授權(quán)內(nèi)容與職權(quán)范圍的邊界、明晰教師權(quán)責(zé)的邊界和學(xué)生的合法權(quán)益、明確學(xué)校辦學(xué)經(jīng)費(fèi)的成本核算和劃撥細(xì)則以及對(duì)各級(jí)各類學(xué)校的制度建設(shè)和建筑標(biāo)準(zhǔn)予以嚴(yán)格規(guī)范等具體立法建議與舉措。
[Abstract]:The School Education Act is the substantive law concerning all schools and school undertakings.For a long time in our country, there are some misunderstandings on the understanding level, and there are many regional differences, and the relationship between the School Education Law and other educational laws has not been well clarified, and so on.The delay in the enactment of the National School Education Law has not only resulted in a serious imbalance in the national education legal system, the unclear powers and responsibilities of the multi-party relations at the micro level of education, and the inability to follow the internal governance of the school.At the same time, it also causes many problems and malpractices, such as the hidden hiding of the basic rights and interests that students should enjoy.Through combing the reality of the appeal legislation, it is proposed that the establishment of the School Education Law should clarify the nature of all kinds of schools at all levels, and define the content of the principal's legal authorization and the boundary between the terms of reference,This paper clarifies the boundary of teachers' rights and responsibilities and the legitimate rights and interests of students, clarifies the rules of cost accounting and allocation of school funds, and strictly standardizes the system construction and building standards of schools at all levels and all kinds of schools, and so on.
