【摘要】：土地利用合理與否,歸根結(jié)底取決于生活在這片土地之上的人們是否能夠公平的享有這片土地的財(cái)產(chǎn)收益。我國(guó)土地利用法律制度,以“社會(huì)主義公有制”為理論淵源,它要求土地資源的管理應(yīng)當(dāng)吸納社會(huì)共同體多數(shù)成員甚至全體成員的意志,土地利用收益應(yīng)當(dāng)兼顧個(gè)人利益和公共利益。但從“國(guó)家權(quán)力——市場(chǎng)權(quán)利”相互博弈的角度來(lái)看,我國(guó)當(dāng)前的土地利用法律制度存在著“強(qiáng)國(guó)家權(quán)力——強(qiáng)市場(chǎng)權(quán)利”的總體特征。這種特征在沒(méi)有完善的民主制度和宏觀調(diào)控制度加以約束和調(diào)整的情況下,極易導(dǎo)致土地利用收益被土地管理權(quán)力者和其他市場(chǎng)強(qiáng)勢(shì)主體所攫取,以致扭曲公民應(yīng)當(dāng)依靠勞動(dòng)致富的價(jià)值取向,也擠壓了城市化主體——外來(lái)務(wù)工人員的生存發(fā)展空間,造成社會(huì)嚴(yán)重的不公平和土地資源的不合理利用。因此,在上述土地利用特征及其危害之下,本文提出,我國(guó)土地利用法律制度未來(lái)的發(fā)展路徑,應(yīng)是通過(guò)土地利用民主程序的完善,使得政府土地管理權(quán)力的行使能夠最大程度上與“公意”保持一致;同時(shí),要完善并提高國(guó)家對(duì)房地產(chǎn)市場(chǎng)的宏觀調(diào)控能力,扭轉(zhuǎn)當(dāng)前在土地增值收益分配上所出現(xiàn)的“馬太效應(yīng)”,實(shí)現(xiàn)土地增值收益為社會(huì)共同體成員共享。
[Abstract]:Whether the land use is reasonable or not depends on whether the people who live on the land can enjoy the property income equitably.The legal system of land use in our country takes "socialist public ownership" as its theoretical origin. It requires that the management of land resources should absorb the will of most members or even all members of the social community.Income from land use shall take account of both personal and public interests.However, from the point of view of the game between state power and market right, the present legal system of land use in our country has the general characteristics of "strong state power-strong market right".Without the restriction and adjustment of the perfect democratic system and macro-control system, this characteristic can easily lead to the land use income being seized by the land management authorities and other powerful market players.As a result, it distorts the value orientation that citizens should rely on labor to get rich, and also squeezes the living and development space of the main body of urbanization-migrant workers, resulting in serious social injustice and unreasonable utilization of land resources.Therefore, under the above land use characteristic and its harm, this article proposes that our country land use law system future development path, should be through the land use democratic procedure consummation,To make the exercise of government land management power to the greatest extent consistent with the "public will"; at the same time, to improve and improve the state's ability to control the real estate market macroscopically,To reverse the "Matthew effect" in the distribution of land value-added income, and to realize the sharing of land value-added income for the members of the social community.
