【摘要】：近年來，我國有關(guān)民辦高校的研究越來越多。大部分學(xué)者都認為，應(yīng)將非營利性民辦高校與營利性民辦高校進行分類管理。但是，在分類管理后，非營利性民辦高校如何發(fā)展，其法律地位、優(yōu)惠政策如何保障，對諸如此類的問題，學(xué)者們探討得較少。本研究即從法律文本的角度來看待非營利性民辦高校的發(fā)展。 本研究以定性研究為主，所采用的研究方法為文獻法、案例法、調(diào)查法。通過對現(xiàn)有法律文本的分析以及吉林華僑外國語學(xué)院、浙江樹人大學(xué)等非營利性民辦高校的研究，看到了非營利性民辦高校在發(fā)展中存在的問題。 本研究共分為五個部分。第一部分為引言部分。在這一部分內(nèi)，主要本研究的研究基本概況進行了闡述。第二部分為理論基礎(chǔ)。以教育公益性理論、教育產(chǎn)權(quán)理論、教育收入分配理論作為本研究的理論支撐。第三部分為非營利性民辦高校的發(fā)展現(xiàn)狀。在該章中，筆者由非營利性民辦高校的設(shè)立、變更、終止談起，接著談到目前學(xué)校外在的運行保障，以及內(nèi)部財務(wù)管理制度，最后談及內(nèi)部主體利益的保障。由外而內(nèi)地對非營利性民辦高校的發(fā)展現(xiàn)狀進行了闡述。第四部分為發(fā)展非營利性民辦高校的法律缺失。主要由第三章中的發(fā)展現(xiàn)狀，看到了目前在非營利性民辦高校發(fā)展中存在的法律缺失。第五部分為非營利性民辦高校的法律保障。由于在非營利性民辦高校的發(fā)展中存在著法律缺失，因此想要發(fā)展非營利性民辦高校，，則必須要對非營利性民辦高校的發(fā)展提供法律保障。在這一部分中，主要針對第四部分中提到的法律缺失，提出相應(yīng)的保障措施，從而使得非營利性民辦高校健康發(fā)展。
[Abstract]:In recent years, there are more and more researches on private colleges and universities in China.Most scholars believe that non-profit private colleges and for-profit private colleges should be managed by classification.However, after classified management, how to develop, how to protect the legal status and preferential policies of non-profit private colleges and universities are less discussed by scholars.This study looks at the development of non-profit private colleges from the perspective of legal texts.This research is mainly qualitative research, the research methods are literature method, case law, investigation method.Through the analysis of the existing legal texts and the research of Jilin overseas Chinese Foreign language University, Zhejiang Shuren University and other non-profit private colleges, the problems in the development of non-profit private colleges and universities are found.This study is divided into five parts.The first part is the introduction.In this part, the main research on the basic situation of the elaboration.The second part is the theoretical basis.The theoretical support of this study is educational public welfare theory, educational property right theory and educational income distribution theory.The third part is the development of non-profit private colleges and universities.In this chapter, the author talks about the establishment, change and termination of the non-profit private colleges and universities, then discusses the external operation guarantee of the school, and the internal financial management system, and finally discusses the protection of the interests of the internal main body.The development status of non-profit non-profit private colleges and universities is expounded from the outside and inland.The fourth part is the lack of law to develop non-profit private colleges.Mainly from the third chapter of the development of the status quo, see the current development of non-profit private colleges and universities in the lack of law.The fifth part is the legal protection of non-profit private colleges and universities.Because there is a lack of law in the development of non-profit private colleges and universities, it is necessary to provide legal guarantee for the development of non-profit private colleges and universities if we want to develop them.In this part, aiming at the legal deficiency mentioned in the fourth part, the corresponding safeguard measures are put forward to make the non-profit private colleges and universities develop healthily.
