【摘要】：“釣魚執(zhí)法”一詞自“上海孫中界事件”后逐漸為公眾所熟知,后引起社會(huì)各界對(duì)此種執(zhí)法方式的廣泛熱議。它是指行政執(zhí)法人員對(duì)行政相對(duì)人以誘惑的方式實(shí)施的行政執(zhí)法活動(dòng),此種執(zhí)法方式一經(jīng)媒體曝光便受到社會(huì)各界一邊倒的批評(píng),相關(guān)部門也早已明確表示此種執(zhí)法方式不符合既有法律規(guī)定的要求。然而時(shí)至今日,一些執(zhí)法人員采取類似“釣魚執(zhí)法”的方式進(jìn)行執(zhí)法的現(xiàn)象依舊普遍存在,這不僅有違合法行政的基本原則,同樣也侵犯了當(dāng)事人的切身利益,從而在本質(zhì)上妨礙了我國法治建設(shè)前進(jìn)的步伐。因此,為了能對(duì)“釣魚執(zhí)法”現(xiàn)象有更為全面的認(rèn)知,本文將從該行為基本的定義與特征入手,以近期發(fā)生的幾起“釣魚執(zhí)法”相關(guān)事件為切入點(diǎn),結(jié)合以往學(xué)術(shù)界對(duì)于此問題的不同觀點(diǎn),重新梳理“釣魚執(zhí)法”相關(guān)理論,闡述自己對(duì)于該種執(zhí)法方式的違法性及成因的看法,以達(dá)到全面認(rèn)識(shí)“釣魚執(zhí)法”這一問題之所在,并在此基礎(chǔ)之上提出對(duì)于處理該問題的合理對(duì)策,以期警示有關(guān)行政機(jī)關(guān)在執(zhí)法過程中要堅(jiān)持合法行政的基本原則,杜絕行使一切形式的“釣魚執(zhí)法”方式,從而為推動(dòng)我國法治國家的建設(shè)起到積極作用。
[Abstract]:The term "fishing law enforcement" has been well known to the public since the "Sun Zhongjie incident in Shanghai", which has caused widespread discussion of this kind of law enforcement method.It refers to the administrative law enforcement activities carried out by the administrative law enforcement personnel to the administrative counterpart in an enticing manner, which, once exposed by the media, is criticized by all circles of the society one-sided.Relevant departments have also made it clear that such enforcement does not meet the requirements of the existing law.Today, however, some law enforcement officials still use a similar "fishing law enforcement" method to enforce the law, which not only violates the basic principles of legal administration, but also violates the vital interests of the parties concerned.In essence, it hinders the progress of the construction of the rule of law in our country.Therefore, in order to have a more comprehensive understanding of the phenomenon of "fishing law enforcement", this paper will start with the basic definition and characteristics of the behavior, taking several recent "fishing law enforcement" related events as the starting point.Combining with the different viewpoints of the academic circles on this issue, this paper reorganizes the relevant theories of "fishing enforcement", expounds their views on the illegality and causes of this kind of law enforcement, in order to achieve a comprehensive understanding of the problem of "fishing law enforcement".On this basis, the author puts forward reasonable countermeasures to deal with the problem, in order to warn the relevant administrative organs to adhere to the basic principle of lawful administration in the course of enforcing the law, and to put an end to the exercise of all forms of "fishing law enforcement".In order to promote the construction of China's rule of law country play a positive role.
