【摘要】:現(xiàn)代社會飛速發(fā)展,政府的體量逐漸增大,職權(quán)越發(fā)細密,所掌握的政府信息也逐漸增多。作為承接了部分政府公共服務(wù)職能公共企事業(yè)單位,同樣掌握著大量信息。這些信息關(guān)涉著公共利益的實現(xiàn),同政府信息一樣實行公開,服務(wù)公眾就成為一種必然。我國《政府信息公開條例》第37條中規(guī)定了公共企事業(yè)單位是信息公開的法定義務(wù)主體,但條文過于概括,沒有對公共企事業(yè)單位信息公開具體的主體資格,信息范圍,公開方式,申請人的救濟途徑等問題做出細密的規(guī)定。導致法條難以適用,指導性,操作性不強。文章從我國立法關(guān)于公共企事業(yè)單位的定義切入,通過歸納公共企業(yè)和事業(yè)單位的共性和特性,對二者的內(nèi)涵和外延做出了詳細的界定,通過對公共企事業(yè)單位的公益性,壟斷性和應(yīng)受規(guī)制性的一一介紹與分析,概括了發(fā)展公共利益的目的和意義,并指出政府職權(quán)社會化和保障公眾知情權(quán)是公共企事業(yè)單位信息公開的理論出發(fā)點。本文針對目前我國公共企事業(yè)單位信息公開所面臨的主體不明確,范圍不清晰,公開方式不具體以及救濟途徑不暢通等問題,結(jié)合典型案例,提出了自己的建議和設(shè)想。提出了應(yīng)該具體化“人民利益密切相關(guān)”的涵義,作為判別義務(wù)主體的標準;明確應(yīng)當公開的信息內(nèi)容分類,細化公開豁免事項的來明確信息公開的范圍和邊界。確立網(wǎng)絡(luò)公開主要渠道的地位,大力發(fā)展互聯(lián)網(wǎng)+的信息公開模式,提高信息公開的效率,節(jié)約成本。在針對信息公開救濟途徑不暢的情況,介紹了英日等國家的相關(guān)立法和實踐成果與經(jīng)驗,提出了效仿他國,探索設(shè)立中立的信息公開專門機關(guān)來實現(xiàn)對相關(guān)信息公開的咨詢,引導,監(jiān)管和救濟,提高信息公開的效率,保障路徑的合法和獨立,并對增設(shè)機構(gòu)的合理性做了討論,希望為此辦法的實現(xiàn)尋找合理的依據(jù)。
[Abstract]:With the rapid development of modern society, the amount of government has gradually increased, the power of government has become more and more detailed, and the government information has been gradually increased.As a part of the government to undertake public service functions of public enterprises and institutions, also holds a large amount of information.These information is related to the realization of public interest.Article 37 of our country's regulations on the publicity of Government Information stipulates that public enterprises and institutions are the subject of legal obligations for information disclosure, but the provisions are too general, and there is no specific subject qualification and scope of information disclosure for public enterprises and institutions.The public way, the applicant's remedy way and so on the question makes the detailed stipulation.As a result, the law is difficult to apply, instructive, and not operational.The article begins with the definition of public enterprises and institutions in our country, through summing up the commonalities and characteristics of public enterprises and institutions, defines the connotation and extension of the two in detail, and through the public welfare of public enterprises and institutions,The introduction and analysis of monopoly and regulation generalize the purpose and significance of developing public interest and point out that the socialization of government authority and the protection of public right to know are the theoretical starting point for public enterprises and institutions to open information.In view of the problems that the main body, the scope, the way of disclosure and the ways of relief are not clear, the author puts forward his own suggestions and ideas in the light of typical cases in the light of the problems faced by the public enterprises and institutions in our country at present.This paper puts forward that the meaning of "the people's interests are closely related" should be concretized as the criterion of judging the subject of obligation, and that the classification of information content should be made public, and that the scope and boundary of information disclosure should be clarified.It is necessary to establish the status of the main channels of network openness, to develop the mode of information disclosure on the Internet, to improve the efficiency of information disclosure and to save costs.In view of the lack of relief channels for information disclosure, this paper introduces the relevant legislative and practical achievements and experiences of Britain and Japan, and proposes to follow the example of other countries and explore the establishment of a neutral specialized agency for information disclosure to carry out consultation on relevant information disclosure.Guide, supervise and relief, improve the efficiency of information disclosure, guarantee the legitimacy and independence of the path, and discuss the rationality of the establishment of the organization, hoping to find a reasonable basis for the realization of this method.
