食品安全公共警告的違法判斷標(biāo)準(zhǔn)

【摘要】:公共警告是一種由行政機(jī)關(guān)向社會(huì)公眾發(fā)布信息提示風(fēng)險(xiǎn)的行政管理活動(dòng)。在食品安全領(lǐng)域,行政機(jī)關(guān)通過(guò)及時(shí)公布食品安全公共警告,能有效提高自身對(duì)風(fēng)險(xiǎn)的管理效率和社會(huì)公眾對(duì)風(fēng)險(xiǎn)的規(guī)避能力。然而,一旦行政機(jī)關(guān)在食品安全公共警告中將風(fēng)險(xiǎn)源指向特定的食品,該食品的生產(chǎn)經(jīng)營(yíng)者作為被公布方往往會(huì)受到不利影響,尤其是一則違法的食品安全公共警告,更會(huì)導(dǎo)致被公布方的合法權(quán)益受到損害。若想要通過(guò)行政救濟(jì)的方式保護(hù)被公布方的合法權(quán)利,面臨的首要問(wèn)題,就是如何判斷行政機(jī)關(guān)基于對(duì)不確定風(fēng)險(xiǎn)作出預(yù)測(cè)而公布的食品安全公共警告是否違法。立法上關(guān)于食品安全公共警告違法判斷標(biāo)準(zhǔn)的規(guī)定可以從四個(gè)方面進(jìn)行解讀:行政機(jī)關(guān)有權(quán)公布、內(nèi)容準(zhǔn)確客觀、適用依據(jù)合法和符合法定程序。食品安全公共警告是針對(duì)不確定風(fēng)險(xiǎn)作出的信息發(fā)布行為,反思發(fā)現(xiàn),在不確定風(fēng)險(xiǎn)的影響下,不能僅以立法上規(guī)定的內(nèi)容不準(zhǔn)確不客觀和不符合法定程序就認(rèn)為食品安全公共警告違法。圍繞著不確定風(fēng)險(xiǎn)這一特征,判斷食品安全公共警告的信息內(nèi)容是否違法,關(guān)鍵在于其內(nèi)容是否以合理的風(fēng)險(xiǎn)預(yù)測(cè)結(jié)果為基礎(chǔ),判斷食品安全公共警告的公布程序是否違法,關(guān)鍵在于其對(duì)于風(fēng)險(xiǎn)的預(yù)測(cè)和公布是否符合法定程序和正當(dāng)程序的要求。最后,本文以立法上規(guī)定的主體標(biāo)準(zhǔn)和依據(jù)標(biāo)準(zhǔn),結(jié)合修正后的內(nèi)容標(biāo)準(zhǔn)和程序標(biāo)準(zhǔn),得出關(guān)于食品安全公共警告違法判斷標(biāo)準(zhǔn)的最終結(jié)論。
[Abstract]:Public warning is an administrative activity in which the administrative organs issue information to the public to prompt the risks.In the field of food safety, administrative organs can effectively improve their efficiency of risk management and the ability of the public to evade risks by issuing public warnings on food safety in a timely manner.However, once the agency points the source of risk to a particular food in a public warning on food safety, the producers and operators of the food are often adversely affected, especially by an illegal public warning on food safety.It will also lead to damage to the legitimate rights and interests of the publicised party.If we want to protect the legitimate rights of the published party through administrative relief, the most important problem is how to judge whether the public warning on food safety published by the administrative organ based on the prediction of uncertain risk is illegal.The provisions of legislation on the judgment standard of food safety public warning violation can be interpreted from four aspects: the administrative organ has the power to publish, the content is accurate and objective, the applicable basis is legal and conforms to the legal procedure.Public warning of food safety is an act of publishing information in response to uncertain risks. The reflection found that under the influence of uncertain risks,Food safety public warning should not be regarded as illegal merely on the basis of imprecise and objective content stipulated in legislation and inconsistent with legal procedures.The key to judge whether the information content of food safety public warning is illegal is to judge whether the publication procedure of food safety public warning is illegal on the basis of reasonable risk forecast result.The key is whether the risk prediction and disclosure meet the requirements of due process and due process.Finally, based on the subject standard and basis standard stipulated in legislation, combined with the revised content standard and procedure standard, this paper draws the final conclusion about the judgment standard of food safety public warning violation.
