【摘要】：醫(yī)療損害鑒定結(jié)論在處理醫(yī)療損害糾紛案件中起決定性作用,成為處理醫(yī)療案件的重要環(huán)節(jié)。在大量文獻(xiàn)檢索醫(yī)療鑒定關(guān)鍵詞的基礎(chǔ)上,通過(guò)對(duì)司法實(shí)踐現(xiàn)狀的分析,發(fā)現(xiàn)我國(guó)目前"二元化"醫(yī)療損害鑒定模式在實(shí)踐中存在沖突和弊端,對(duì)醫(yī)療事故技術(shù)鑒定和醫(yī)療過(guò)錯(cuò)司法鑒定機(jī)制進(jìn)行選擇性的整合,構(gòu)建醫(yī)療損害鑒定"一元"模式是未來(lái)發(fā)展的局勢(shì),需要統(tǒng)一鑒定機(jī)構(gòu)和鑒定程序、整合鑒定主體、規(guī)范質(zhì)證環(huán)節(jié)、完善法律法規(guī)。
[Abstract]:The conclusion of medical injury appraisal plays a decisive role in the treatment of medical injury disputes and becomes an important link in handling medical cases.Based on the analysis of the current situation of judicial practice, it is found that there are conflicts and drawbacks in the current mode of "dualistic" medical damage appraisal in our country, on the basis of a large number of documents searching for the keywords of medical identification, and through the analysis of the present situation of judicial practice,The selective integration of the technical identification of medical malpractice and the judicial identification mechanism of medical fault, and the construction of the "monistic" mode of medical injury identification are the future development situations. It is necessary to unify the identification institutions and procedures, and integrate the main body of identification.We will standardize cross-examination and improve laws and regulations.
