【摘要】：最近幾年,隨著我國環(huán)境污染事件的不斷出現(xiàn),環(huán)境污染事件背后的環(huán)境行政不作為開始成為社會關(guān)注的話題。環(huán)境行政不作為是環(huán)境行政主體消極履行、不完全履行或不履行自身環(huán)境行政職責(zé)的違反行為,該行為不僅會嚴(yán)重?fù)p害環(huán)境行政相對人的合法權(quán)益,損害公民的環(huán)境權(quán)益和社會的公共利益,而且會損害政府的形象,影響社會的和諧穩(wěn)定。雖然近年來我國出臺了許多環(huán)境保護(hù)方面的法律法規(guī)和相關(guān)政策,但我國不斷惡化的空氣、水質(zhì)、土質(zhì)以及日益嚴(yán)重的環(huán)境污染問題,從不同的角度反映出我國環(huán)境行政領(lǐng)域的不作為問題尚未得到有效的解決。而形成環(huán)境行政不作為的最主要原因就在于我國現(xiàn)行的環(huán)境行政不作為監(jiān)督機(jī)制還不夠健全,缺乏對環(huán)境行政不作為的有效監(jiān)督,難以有效的預(yù)防和減少環(huán)境行政不作為的發(fā)生。因此,非常有必要對環(huán)境行政不作為的監(jiān)督機(jī)制進(jìn)行研究,研究的成果對規(guī)范我國環(huán)境行政主體的行政不作為行為,實(shí)現(xiàn)經(jīng)濟(jì)和社會的可持續(xù)發(fā)展有很好的促進(jìn)作用。本文試圖對環(huán)境行政不作為監(jiān)督機(jī)制進(jìn)行比較系統(tǒng)地研究,通過對環(huán)境行政不作為監(jiān)督機(jī)制存在的問題進(jìn)行分析,提出建立和完善環(huán)境行政不作為監(jiān)督機(jī)制的構(gòu)想。全文共分為六個(gè)部分:第一部分說明了論文的選題背景、研究綜述、研究目的、研究意義、研究方法等內(nèi)容,對全文有概括性的認(rèn)識;第二部分分析了環(huán)境行政不作為的概念、特征、表現(xiàn)形式和形成原因,對環(huán)境行政不作為有個(gè)初步的認(rèn)識;第三部分分析了環(huán)境行政監(jiān)督機(jī)制的概念和構(gòu)成,為下一步的研究打下基礎(chǔ);第四部分分析了我國環(huán)境行政不作為監(jiān)督機(jī)制存在的問題,為完善環(huán)境行政不作為監(jiān)督機(jī)制提供鋪墊;第五部分是本文研究的重點(diǎn),針對現(xiàn)行監(jiān)督機(jī)制存在的問題,從加強(qiáng)監(jiān)督主體的監(jiān)督力度和完善相關(guān)監(jiān)督制度兩大方面提出了我國環(huán)境行政不作為監(jiān)督機(jī)制的完善措施;最后結(jié)論部分簡明扼要地重申自己得到的研究成果。筆者期望通過這些措施的綜合運(yùn)用,能規(guī)范環(huán)境行政主體的環(huán)境行政行為,達(dá)到預(yù)防和減少環(huán)境行政不作為的發(fā)生,維護(hù)國家的公共利益和公民的合法權(quán)益,實(shí)現(xiàn)我國經(jīng)濟(jì)社會可持續(xù)發(fā)展的目的。
[Abstract]:In recent years, with the continuous emergence of environmental pollution events in China, the environmental administrative inaction behind environmental pollution events has become a topic of social concern.Environmental administrative omission is a violation of environmental administrative subject's negative performance, not fully performing or failing to perform its own environmental administrative duties. The act will not only seriously damage the legitimate rights and interests of the environmental administrative counterpart,The environmental rights and interests of citizens and the public interests of the society will be damaged, and the image of the government will be damaged and the harmony and stability of the society will be affected.Although China has issued many laws and regulations and related policies on environmental protection in recent years, the worsening air, water quality, soil quality and increasingly serious environmental pollution problems in our country.It reflects from different angles that the problem of inaction in the field of environmental administration in China has not yet been effectively resolved.The main reason for the environmental administrative omission is that the current supervision mechanism of the environmental administrative omission is not perfect enough, and it lacks the effective supervision of the environmental administrative omission.It is difficult to effectively prevent and reduce the occurrence of environmental administrative omission.Therefore, it is very necessary to study the supervision mechanism of environmental administrative omission. The results of the research have a good promoting effect on standardizing the administrative omission behavior of environmental administrative subject in China and realizing the sustainable development of economy and society.This paper attempts to make a systematic study on the supervision mechanism of environmental administrative omission, and through the analysis of the problems existing in the supervision mechanism of environmental administrative omission, puts forward the idea of establishing and perfecting the supervision mechanism of environmental administrative omission.The paper is divided into six parts: the first part explains the background of the thesis, research review, research purposes, research significance, research methods and other content, the second part of the analysis of the concept of environmental administrative inaction,The third part analyzes the concept and constitution of the environmental administrative supervision mechanism, which lays a foundation for the next research.The fourth part analyzes the problems existing in the supervision mechanism of environmental administrative omission in China, and provides the foundation for perfecting the supervision mechanism of environmental administrative omission. The fifth part is the focus of this paper, aiming at the existing problems of the current supervision mechanism.From two aspects of strengthening the supervision of the main body of supervision and perfecting the relevant supervision system, this paper puts forward the perfect measures of the supervision mechanism of environmental administrative omission in China, and the final conclusion simply and concisely restates the research results that we have obtained.The author hopes that through the comprehensive application of these measures, the environmental administrative behavior of environmental administrative subjects can be standardized, and the occurrence of environmental administrative inaction can be prevented and reduced, and the public interests of the country and the legitimate rights and interests of citizens can be safeguarded.To achieve the goal of sustainable economic and social development in China.
