【摘要】：“節(jié)能降耗”是生態(tài)文明建設(shè)的重要內(nèi)容和“十二五”社會(huì)經(jīng)濟(jì)發(fā)展的重要目標(biāo)。加強(qiáng)能源執(zhí)法,以監(jiān)督促管理、降能耗具有重要的現(xiàn)實(shí)意義。 “十一五”時(shí)期,溫州市在“節(jié)能降耗”工作方面做出了努力,萬(wàn)元GDP能耗下降了21.7%,但“十二五”期間若需完成再下降15%的目標(biāo),將遇到節(jié)能空間相對(duì)萎縮、用能持續(xù)增長(zhǎng)等現(xiàn)實(shí)困境。為了構(gòu)建扎實(shí)的溫州市能源執(zhí)法體系,提升能源執(zhí)法工作水平,進(jìn)而促進(jìn)溫州市“十二五”節(jié)能降耗目標(biāo)的順利實(shí)現(xiàn),論文以新公共管理理論、市場(chǎng)失靈與政府干預(yù)理論、系統(tǒng)理論為指導(dǎo),應(yīng)用文獻(xiàn)資料法分析當(dāng)前節(jié)能法律制度體系存在的不健全和執(zhí)行難問(wèn)題,結(jié)合工作中了解到的溫州市用能企業(yè)內(nèi)部節(jié)能管理薄弱的問(wèn)題和能源執(zhí)法機(jī)構(gòu)能力建設(shè)不均衡的問(wèn)題。分析溫州市的節(jié)能形勢(shì)以及對(duì)能源執(zhí)法的要求,應(yīng)用系統(tǒng)分析法分析構(gòu)建能源執(zhí)法系統(tǒng)存在的內(nèi)部、外部的影響因素,結(jié)果表明能源執(zhí)法工作不但深受內(nèi)部的能源執(zhí)法目標(biāo)任務(wù)、能源執(zhí)法工作制度、能源執(zhí)法人員能力、能源執(zhí)法組織結(jié)構(gòu)等因素制約,而且受到外部的能源執(zhí)法法律制度、能源執(zhí)法技術(shù)支撐、能源執(zhí)法對(duì)象結(jié)構(gòu)、能源執(zhí)法環(huán)境氛圍、等因素影響。溫州市當(dāng)前能源執(zhí)法面臨的具體的問(wèn)題表現(xiàn)在：能源執(zhí)法目標(biāo)任務(wù)制定不科學(xué)、內(nèi)部工作制度不完善、能源執(zhí)法能力不適應(yīng)節(jié)能降耗需要、能源執(zhí)法組織結(jié)構(gòu)不合理；能源執(zhí)法法律制度體系不完善、能源執(zhí)法技術(shù)支撐不足、能源執(zhí)法對(duì)象節(jié)能管理機(jī)制不健全、能源執(zhí)法環(huán)境待改善。本文還對(duì)國(guó)外節(jié)能工作經(jīng)驗(yàn)進(jìn)行了比較和借鑒,進(jìn)而提出促使溫州市能源執(zhí)法工作更富成效的對(duì)策：科學(xué)制定能源執(zhí)法目標(biāo)任務(wù)、健全內(nèi)部工作制度、強(qiáng)化能源執(zhí)法能力建設(shè)、調(diào)整能源執(zhí)法組織結(jié)構(gòu)；完善能源執(zhí)法法律制度配套、強(qiáng)化用能單位執(zhí)法管理、培育和依托第三方技術(shù)支持、運(yùn)用經(jīng)濟(jì)手段和市場(chǎng)手段、改善能源執(zhí)法環(huán)境。
[Abstract]:"Saving energy and reducing consumption" is the important content of the construction of ecological civilization and the important target of the social and economic development of the 12th Five-Year Plan. It is of great practical significance to strengthen the law enforcement of energy, to supervise and promote management, and to reduce energy consumption. During the 11th Five-Year Plan period, Wenzhou has made efforts in the work of "saving energy and reducing consumption." the energy consumption of 10,000 yuan GDP has dropped by 21.70.But if the target of 15% further reduction is to be completed during the 12th Five-Year Plan period, the energy saving space will shrink relatively. In order to construct a solid energy law enforcement system in Wenzhou, to improve the level of energy law enforcement, and to promote the smooth realization of the energy conservation and consumption reduction goal in Wenzhou during the 12th Five-Year Plan, the paper uses the new public management theory. Under the guidance of the theory of market failure and government intervention and the system theory, this paper applies the method of literature and data to analyze the problems existing in the current legal system of energy conservation, such as unsoundness and difficulty in implementation. Combined with the problems of weak energy conservation management in Wenzhou energy enterprises and uneven capacity-building of energy law enforcement agencies, the energy conservation situation and the requirements for energy law enforcement in Wenzhou City were analyzed. The internal and external factors influencing the energy law enforcement system are analyzed by using the system analysis method. The results show that the energy law enforcement work is not only deeply affected by the internal energy law enforcement target task, the energy law enforcement work system, the energy law enforcement personnel ability, The energy law enforcement organization structure and other factors are restricted by the external energy law enforcement legal system, the energy law enforcement technology support, the energy law enforcement object structure, the energy law enforcement environment atmosphere, The specific problems faced by Wenzhou's current energy law enforcement include: unscientific formulation of energy law enforcement objectives, imperfect internal work system, inadequate energy law enforcement capacity to meet the needs of energy conservation and consumption reduction, The organization structure of energy law enforcement is unreasonable, the legal system of energy law enforcement is not perfect, the technical support of energy law enforcement is insufficient, the energy law enforcement object energy conservation management mechanism is not perfect, The energy law enforcement environment needs to be improved. This paper also compares and draws lessons from the experience of foreign energy conservation work, and then puts forward some countermeasures to promote the energy law enforcement work in Wenzhou: to scientifically formulate the energy law enforcement target task, to perfect the internal work system, To strengthen the building of energy law enforcement capacity, to adjust the energy enforcement organization structure, to improve the legal system of energy law enforcement, to strengthen the law enforcement management of energy-using units, to foster and rely on the technical support of third parties, and to use economic and market means, Improving the energy enforcement environment.
