沈陽市學(xué)前教育保障條例立法建議稿(附理由)

【摘要】:近年來,隨著我市學(xué)前教育市場的迅速發(fā)展,,各種新的問題不斷出現(xiàn),這不僅引起了廣大家長的急切關(guān)注,也引起了廣泛的專家學(xué)者對我市學(xué)前教育立法的深入探討。在國家層面,國務(wù)院教育部提出要制定一個全國范圍的學(xué)前教育法案,有效協(xié)調(diào)學(xué)前教育機(jī)構(gòu)、學(xué)前教育兒童和學(xué)前教育教師的權(quán)利和利益,以促進(jìn)學(xué)前教育事業(yè)的規(guī)范和發(fā)展。在省市級別,已有江蘇省、北京市、合肥市、上海市等制定了本。ㄊ校┑膶W(xué)前教育(管理)條例,明確規(guī)定了學(xué)前教育的經(jīng)費來源、師資保障和學(xué)齡前兒童權(quán)利維護(hù)等具體內(nèi)容,為當(dāng)?shù)氐膶W(xué)前教育發(fā)展奠定了堅實的法治基礎(chǔ)。 本文主要包括三個部分:我市學(xué)前教育的立法背景、我市學(xué)前教育立法的必要性和可行性以及我市學(xué)前教育保障條例立法建議稿。在學(xué)前教育立法背景的論述中,筆者主要是在對學(xué)前教育相關(guān)問題的立法歷程進(jìn)行一個時間上的梳理,并在這個梳理結(jié)果的基礎(chǔ)上找出我市學(xué)前教育在立法實踐中遇到的問題,為我市學(xué)前教育立法重點和難點提供法律上的經(jīng)驗和教訓(xùn),并指出我市學(xué)前教育立法該如何更好地貫徹和執(zhí)行上位法。本文的第二個部分主要是對我市學(xué)前教育立法進(jìn)行必要性和可行性分析,目的在于為我市學(xué)前教育立法提供實踐上的依據(jù)。最后,筆者在前文的論述和分析的基礎(chǔ)上,結(jié)合我市學(xué)前教育發(fā)展的實際情況,總結(jié)出我市學(xué)前教育的立法重點,并形成一個完整的立法草案建議稿,該建議稿主要包括學(xué)前教育的性質(zhì)、兒童權(quán)利維護(hù)、師資權(quán)利保障、辦園資質(zhì)、經(jīng)費保障和懲處機(jī)制等主要內(nèi)容,為使該建議稿更具有說服力,筆者在草案中附上了相應(yīng)的解釋說明和立法理由。本文中的立法草案建議稿是在對我市學(xué)前教育發(fā)展情況深入調(diào)研,并在深入分析和把握上位法的立法精神并結(jié)合其他省市立法的成功經(jīng)驗的基礎(chǔ)上構(gòu)思出來的,這就是本文的最大亮點。
[Abstract]:In recent years, with the rapid development of the pre-school education market in our city, various new problems are constantly emerging, which has not only aroused the urgent concern of parents, At the national level, the Ministry of Education of the State Council has proposed to formulate a nationwide preschool education bill to effectively coordinate preschool education institutions. The rights and interests of preschool education children and teachers in order to promote the standardization and development of preschool education. At the provincial and municipal levels, there are already Jiangsu Province, Beijing Municipality, Hefei City, Shanghai and others have formulated the regulations on preschool education (administration) in their respective provinces (cities), which clearly specify the sources of funding for pre-school education, the protection of teachers and the protection of the rights of preschool children, etc. For the local development of preschool education laid a solid foundation for the rule of law. This paper mainly includes three parts: the legislative background of pre-school education in our city, the necessity and feasibility of the legislation of pre-school education in our city, and the proposal of legislation of the pre-school education protection regulations of our city. The author mainly combs the legislative course of the related problems of preschool education in a time, and finds out the problems encountered in the legislative practice of pre-school education in our city on the basis of this combing result. To provide legal experience and lessons for the key points and difficulties of our city's pre-school education legislation, The second part of this paper mainly analyzes the necessity and feasibility of pre-school education legislation in our city. The purpose is to provide practical basis for the legislation of pre-school education in our city. Finally, on the basis of the discussion and analysis above, the author sums up the legislative emphases of pre-school education in our city on the basis of the actual situation of the development of pre-school education in our city. And form a complete draft proposal for legislation, which mainly includes the nature of pre-school education, the protection of children's rights, the protection of the rights of teachers, the qualifications for running the garden, the funding guarantee and the punishment mechanism, and so on. In order to make the proposal more persuasive, the author appends the corresponding explanation and legislative reasons to the draft. The proposal in this paper is an in-depth investigation on the development of preschool education in our city. And on the basis of deeply analyzing and grasping the legislative spirit of upper law and combining with the successful experience of other provinces and cities, this is the greatest bright spot of this paper.
