【摘要】：立法是我國應(yīng)對氣候變化進程的必由之路�！栋屠鑵f(xié)定》中"國家自主貢獻"模式的確立為我國氣候立法工作指明了方向。在國家立法遇阻的情形下,憑借"自下而上"路徑推動我國地方省市先行立法,在國家生態(tài)文明建設(shè)的重大變革期具有現(xiàn)實必要性與可行性。在此路徑的開拓中,地方立法者應(yīng)當(dāng)采取漸進式立法模式,尋求立法空間的擴大,逐步構(gòu)建起地方綜合性應(yīng)對氣候變化法律體系,并加強地方立法中的多元利益協(xié)調(diào)。
[Abstract]:Legislation is the only way for China to cope with climate change. The establishment of the model of "national autonomous contribution" in the Paris Agreement points out the direction of our country's climate legislation. Depending on the "bottom-up" path, it is necessary and feasible for local provinces and cities to legislate in advance in the period of great change in the construction of national ecological civilization. In the development of this path, local legislators should adopt the progressive legislative model. Seek the expansion of legislative space, build up the local comprehensive climate change legal system step by step, and strengthen the multi-interest coordination in the local legislation.
