【摘要】：城管執(zhí)法發(fā)揮著積極的作用,成為城市建設(shè)的重要組成部分。然而,城管執(zhí)法中時(shí)常會(huì)出現(xiàn)沖突問(wèn)題,尤其是城管執(zhí)法主體與執(zhí)法對(duì)象之間存在著沖突,不僅嚴(yán)重地影響到城市建設(shè)效率,而且還使得政府部門形象受到影響,還對(duì)社會(huì)的穩(wěn)定造成了極大的沖擊。針對(duì)城管執(zhí)法中存在的沖突,我國(guó)積極加強(qiáng)城管執(zhí)法中存在沖突的治理,但是,城管執(zhí)法中存在的沖突仍然時(shí)有發(fā)生,造成了極其惡劣的影響。如何有效地強(qiáng)化城管執(zhí)法中存在的沖突治理,成為我國(guó)需要著力解決的問(wèn)題。對(duì)此,本文以城管執(zhí)法沖突治理作為研究對(duì)象,分析了城管執(zhí)法中沖突治理現(xiàn)狀及存在的問(wèn)題,并針對(duì)其中存在的問(wèn)題提出了相應(yīng)的解決對(duì)策。在城管執(zhí)法沖突治理方面,我國(guó)當(dāng)前存在的問(wèn)題主要表現(xiàn)在這些方面,分別為:缺乏責(zé)任主體的認(rèn)定標(biāo)準(zhǔn)、未能建立執(zhí)法沖突的懲處制度、執(zhí)法沖突治理程序規(guī)范性不夠、執(zhí)法沖突治理的監(jiān)管環(huán)節(jié)薄弱。針對(duì)城管執(zhí)法沖突治理機(jī)制的法律問(wèn)題,我國(guó)應(yīng)該充分地認(rèn)識(shí)到這些問(wèn)題的嚴(yán)重性,并要積極采取有力的治理措施,具體措施包括:制定責(zé)任主體認(rèn)定標(biāo)準(zhǔn)、建立執(zhí)法沖突懲處制度、規(guī)范執(zhí)法沖突治理程序、構(gòu)建執(zhí)法沖突治理的監(jiān)管體系。通過(guò)這些措施,能夠?yàn)槲覈?guó)從法律規(guī)制的層面治理城管沖突提供良好的實(shí)踐方法,從而提高我國(guó)城管執(zhí)法沖突治理水平。
[Abstract]:Urban management law enforcement plays an active role and becomes an important part of urban construction. However, conflicts often occur in urban management law enforcement, especially between the main body of urban management law enforcement and the object of law enforcement. It not only seriously affects the efficiency of urban construction, but also affects the image of government departments, and also has a great impact on social stability. China actively strengthens the governance of conflicts in the law enforcement of urban management, but the conflicts in law enforcement of urban management still occur from time to time, resulting in extremely bad effects. How to effectively strengthen the conflict management in the law enforcement of urban management, This paper takes the conflict management of urban management law enforcement as the research object, and analyzes the current situation and existing problems of conflict management in urban management law enforcement. According to the existing problems, the corresponding countermeasures are put forward. In the aspect of urban management law enforcement conflict management, the existing problems in our country are mainly manifested in these aspects, which are: lack of the identification standard of the responsible subject, Failing to establish the punishment system of law enforcement conflict, the law enforcement conflict management procedure is not normative enough, the supervision link of law enforcement conflict management is weak. China should be fully aware of the seriousness of these problems, and actively take effective measures of governance. Specific measures include: establishing standards for the identification of responsible subjects, establishing a system of punishment for law enforcement conflicts, and standardizing the procedures of law enforcement conflict management. Through these measures, we can provide a good practical method for our country to manage the conflict of urban management from the level of legal regulation, so as to improve the level of governance of the conflict of law enforcement in our country.
