【摘要】：治安調(diào)解是基層公安機(jī)關(guān)在解決處理糾紛案件的一種非常重要方式和手段，具備自愿協(xié)商、高效靈活、成本低廉等方面的優(yōu)勢(shì)，不僅可以緩和當(dāng)事人過激情緒，妥善解決糾紛，還可以有效地減輕違法行為人對(duì)社會(huì)的仇視和報(bào)復(fù)心理，有利于維系和睦團(tuán)結(jié)的社會(huì)關(guān)系，促進(jìn)社會(huì)的和諧和穩(wěn)定。 然而，基層公安機(jī)關(guān)及其辦案民警治安調(diào)解實(shí)踐過程中，還存在許多的問題與不足，其原因有制度本身的不完善、執(zhí)法辦案民警治安調(diào)解能力和水平有限等，這就需要我們?cè)谏钊氲交鶎庸矙C(jī)關(guān)治安調(diào)解的實(shí)際工作中去，不斷發(fā)現(xiàn)問題、分析問題，不斷完善基層公安機(jī)關(guān)治安調(diào)解制度，真正發(fā)揮其應(yīng)有的作用。 本文的研究目標(biāo)是研究分析現(xiàn)階段我國(guó)基層公安機(jī)關(guān)治安調(diào)解制度現(xiàn)狀及存在的問題，從而提出進(jìn)一步完善基層公安機(jī)關(guān)治安調(diào)解制度的措施。 本文主要從三個(gè)部分進(jìn)行論述：第一部分是治安調(diào)解的基本理論，，主要包含治安調(diào)解的概念界定、適用范圍和方式、法律效力以及功能作用等內(nèi)容；第二部分是結(jié)合自身的工作實(shí)際，梳理基層公安機(jī)關(guān)治安調(diào)解的現(xiàn)狀和存在的問題，并進(jìn)行原因分析；第三部分是提出進(jìn)一步完善基層公安機(jī)關(guān)治安調(diào)解制度的具體措施。 本文擬解決的關(guān)鍵性問題是分析總結(jié)出當(dāng)前我國(guó)基層公安機(jī)關(guān)治安調(diào)解制度的現(xiàn)狀、存在的問題及完善措施。 本文研究方法——文獻(xiàn)分析法：通過對(duì)報(bào)刊、書籍、雜志、網(wǎng)絡(luò)上（CNKI、萬方、維普等中文學(xué)術(shù)文獻(xiàn)數(shù)據(jù)庫(kù)和國(guó)家科技圖書文獻(xiàn)中心數(shù)據(jù)庫(kù)外文文獻(xiàn)數(shù)據(jù)庫(kù)以及百度搜索）相關(guān)文獻(xiàn)資料的檢索研究，分析基層公安機(jī)關(guān)治安調(diào)解制度研究的現(xiàn)狀，并在此基礎(chǔ)上進(jìn)行研究；歸納法：結(jié)合搜集的資料，運(yùn)用歸納法總結(jié)出我國(guó)基層公安機(jī)關(guān)治安調(diào)解制度的現(xiàn)狀與問題，并提出建議和構(gòu)想。 本文的創(chuàng)新之處在于通過對(duì)基層公安機(jī)關(guān)治安調(diào)解工作的具體分析，總結(jié)歸納出現(xiàn)階段基層公安機(jī)關(guān)治安調(diào)解工作中普遍存在的問題與不足，并在此基礎(chǔ)上提出進(jìn)一步完善我國(guó)基層公安機(jī)關(guān)治安調(diào)解制度的具體措施建議。
[Abstract]:Public security mediation is a very important way and means for public security organs at the grass-roots level to resolve disputes. It has the advantages of voluntary consultation, high efficiency and flexibility, and low cost. It can not only ease the excesses of the parties, but also resolve disputes properly. It can also effectively reduce the criminals' hatred and revenge on the society, help to maintain harmonious and United social relations and promote social harmony and stability. However, there are still many problems and deficiencies in the practice of public security organs at the grass-roots level and their handling of cases, such as the imperfection of the system itself, the limited ability and level of mediation of the police in handling law enforcement cases, and so on. This requires us to go deep into the actual work of public security mediation in grass-roots public security organs, constantly find problems, analyze problems, constantly improve the public security mediation system of grass-roots public security organs, and really play its due role. The research goal of this paper is to study and analyze the present situation and existing problems of the public security mediation system at the grass-roots level in our country, and then put forward some measures to further improve the public security mediation system at the grass-roots level. This paper mainly discusses from three parts: the first part is the basic theory of public security mediation, including the definition of the concept of public security mediation, the scope and methods of application, the legal effect and function; The second part combs the present situation and the existing problems of the public security mediation in the grass-roots public security organs, and analyzes the reasons; the third part is to put forward the concrete measures to further improve the public security mediation system of the grass-roots public security organs. The key problem to be solved in this paper is to analyze and summarize the present situation, existing problems and perfect measures of the public security mediation system at the grass-roots level in our country. This article research method-literature analysis: through the newspapers, books, magazines, online CNKI, Wan Fang, Research on the retrieval of relevant documents in the database of Chinese academic documents such as Weipu, the database of the National Science and Technology Library and Literature Center and the Baidu search), and the analysis of the present situation of the research on the mediation system of public security in the grass-roots public security organs. On the basis of this, inductive method is used to summarize the present situation and problems of the public security mediation system of our country's grass-roots public security organs, and put forward some suggestions and ideas. The innovation of this paper lies in the concrete analysis of the mediation work of the public security organs at the grass-roots level, and summarizes the problems and shortcomings in the mediation work of the public security organs at the grass-roots level. On the basis of this, the author puts forward some concrete measures to improve the public order mediation system of our country's basic public security organs.
