【摘要】：我國(guó)土地制度改革應(yīng)當(dāng)堅(jiān)持漸進(jìn)式改良的路徑,繼續(xù)堅(jiān)持土地國(guó)家所有與集體所有,通過完善集體建設(shè)用地使用權(quán)流轉(zhuǎn)方式以滿足社會(huì)建設(shè)用地需求。信托是集體建設(shè)用地使用權(quán)有效且高效的流轉(zhuǎn)方式,其基本制度構(gòu)造應(yīng)當(dāng)是:農(nóng)村集體經(jīng)濟(jì)組織法人作為委托人,將農(nóng)戶分散土地區(qū)域性集中委托給政府出資設(shè)立的、非營(yíng)利的信托機(jī)構(gòu),再由信托機(jī)構(gòu)對(duì)集體建設(shè)用地進(jìn)行必要整理后轉(zhuǎn)讓給實(shí)際用地人使用;信托收益按照一定比例在農(nóng)戶、集體經(jīng)濟(jì)組織之間分配,政府不參與信托收益的分配,只能依法征稅;政府在整個(gè)過程中要建立健全土地市場(chǎng)準(zhǔn)入管制、流轉(zhuǎn)市場(chǎng)動(dòng)態(tài)監(jiān)測(cè)、農(nóng)民社會(huì)保障等制度,承擔(dān)起保障、調(diào)控、風(fēng)險(xiǎn)監(jiān)管等職責(zé)。
[Abstract]:China's land system reform should adhere to the path of gradual improvement, and continue to adhere to the land state ownership and collective ownership. Trust is an effective and efficient way to transfer the right to use collective construction land to meet the needs of social construction land by perfecting the circulation mode of collective construction land use right. Its basic institutional structure should be as follows: as the principal, the legal person of the rural collective economic organization, as the principal, entrusts the regional centralization of the decentralized land of the peasant household to a non-profit trust institution set up by the government. Second, the trust institution should organize the collective construction land and transfer it to the actual land users; the trust income shall be distributed among farmers and collective economic organizations according to a certain proportion, and the government will not participate in the distribution of trust income, so it can only levy taxes according to law; In the whole process, the government should establish and perfect the land market access control, the dynamic monitoring of the circulation market, the farmers' social security system, and undertake the functions of security, regulation, risk supervision and so on.
