【摘要】：隨著中國特色社會主義市場經(jīng)濟的深入發(fā)展,中國政治體制與經(jīng)濟體制改革步入新的階段,中國行政執(zhí)法人員在行使行政裁量權(quán)時面臨的問題也越來越復雜。由于受到外部因素和內(nèi)部因素的共同影響,部分行政執(zhí)法人員存在濫用行政裁量權(quán)的現(xiàn)象,因此在不斷加強外部監(jiān)督的同時,需要探索加強內(nèi)部監(jiān)督的方式。通過對行政裁量權(quán)內(nèi)部監(jiān)督相關(guān)內(nèi)涵的了解,分析行政裁量權(quán)外部監(jiān)督和內(nèi)部監(jiān)督的優(yōu)點與缺點,行政裁量權(quán)的內(nèi)部監(jiān)督有助于發(fā)揮人的主觀能動性,有助于提高控制行政裁量權(quán)的實效性,有助于填補法律真空地帶,應當進一步推進內(nèi)部監(jiān)督對行政裁量權(quán)的控制。在對行政裁量權(quán)內(nèi)部監(jiān)督的研究分析過程中可以發(fā)現(xiàn)其中還存在薄弱環(huán)節(jié),一是中國行政裁量權(quán)內(nèi)部監(jiān)督法律法規(guī)不健全,二是行政內(nèi)部控權(quán)機關(guān)無法完全發(fā)揮其有效作用,三是內(nèi)部監(jiān)督機制結(jié)構(gòu)不合理。為了加強內(nèi)部監(jiān)督對行政裁量權(quán)控制的有效性,要從以下幾個方面著手,應當加強對行政裁量權(quán)的過程控制,不斷完善行政裁量權(quán)的裁量基準制度,進一步健全行政裁量權(quán)的內(nèi)部監(jiān)督體系,提高行政執(zhí)法人員的綜合素質(zhì),建立行政先例制度。通過以上途徑必然能夠加強內(nèi)部監(jiān)督對行政裁量權(quán)的控制,提高行政執(zhí)法人員行使行政裁量權(quán)的科學性、合理性、合法性,保障每一個百姓的合法利益。
[Abstract]:With the in-depth development of the socialist market economy with Chinese characteristics, China's political and economic system reform has entered a new stage. The problems faced by Chinese administrative law enforcement personnel in exercising their administrative discretion are also becoming more and more complicated. Due to the common influence of external and internal factors, some administrative law enforcement personnel abuse their administrative discretion. Therefore, while strengthening external supervision, it is necessary to explore ways to strengthen internal supervision. Through the understanding of the connotation of internal supervision of administrative discretion, the advantages and disadvantages of external supervision and internal supervision of administrative discretion are analyzed. The internal supervision of administrative discretion helps to give play to the subjective initiative of human beings, to improve the effectiveness of the control of administrative discretion, and to fill the legal vacuum. It is necessary to further promote the control of administrative discretion by internal supervision. In the process of studying and analyzing the internal supervision of administrative discretion, we can find that there are still some weak links among them. One is that the laws and regulations on internal supervision of administrative discretion in China are not perfect. Second, the organs of internal administrative control cannot fully play their effective role, and the third is the irrational structure of the internal supervision mechanism. In order to strengthen the effectiveness of internal supervision over the control of administrative discretion, we should proceed from the following aspects. We should strengthen the process control of administrative discretion, constantly improve the system of administrative discretion benchmark, further improve the internal supervision system of administrative discretion, and improve the comprehensive quality of administrative law enforcement personnel. The establishment of administrative precedent system, through the above channels, can inevitably strengthen the internal supervision of the control of administrative discretion, improve the scientific nature, rationality and legitimacy of the administrative discretion exercised by administrative law enforcement personnel, and protect the legitimate interests of every common people.
