【摘要】：行政主體一方面承擔(dān)日益繁重的行政任務(wù),另一方面又面臨行政資源短缺的情形,這就要求行政主體不斷提升自己的治理能力。行政規(guī)劃作為治理社會的重要手段,有利于節(jié)約行政資源并提升行政效率,已經(jīng)成為行政主體日益青睞的重要行政行為方式。而聽證制度作為行政規(guī)劃的重要約束手段,正在不斷受到重視。行政規(guī)劃聽證制度對于規(guī)范行政規(guī)劃具有不可替代的作用,通過行政主體自身之外的力量參與到行政規(guī)劃過程中,由此形成對行政規(guī)劃權(quán)的控制。尤其是在治理體系和治理能力現(xiàn)代化的時代背景下,行政規(guī)劃聽證制度并不僅僅是公眾的參與手段,更是行政主體與相對人及利害關(guān)系人共同制定行政規(guī)劃的過程。因此,針對我國行政規(guī)劃聽證制度發(fā)展現(xiàn)狀,尤其是結(jié)合《城鄉(xiāng)規(guī)劃法》、《土地管理法》、《水法》以及《礦產(chǎn)資源法》等相關(guān)內(nèi)容,對完善和發(fā)展我國行政規(guī)劃聽證制度提出了一些建議。
[Abstract]:On the one hand, the administrative subject undertakes more and more heavy administrative tasks, on the other hand, it faces the situation of the shortage of administrative resources, which requires the administrative subject to continuously improve its own governance ability. Administrative planning is an important means to govern the society. In order to save administrative resources and improve administrative efficiency, it has become an important mode of administrative behavior that is increasingly favored by administrative subjects, and the hearing system is an important constraint means of administrative planning. Administrative planning hearing system plays an irreplaceable role in standardizing administrative planning, and participates in the process of administrative planning through forces other than the administrative subject itself. The administrative planning hearing system is not just a means of public participation, especially in the context of the modernization of governance system and governance ability. It is also the process of making administrative planning jointly with relative parties and interested parties. Therefore, in view of the present situation of the hearing system of administrative planning in China, In particular, some suggestions are put forward to improve and develop the hearing system of administrative planning in our country, especially in connection with the relevant contents of the Urban and Rural Planning Law, the Land Management Law, the Water Law and the Mineral Resources Law and so on.
