【摘要】：天然橡膠種植引發(fā)了嚴重生態(tài)問題,但橡膠種植生態(tài)保護法治卻存在諸多缺陷,包括防范生態(tài)風險立法極不完善,生態(tài)監(jiān)管難以有效實施,生態(tài)調(diào)控機制嚴重缺失,毀林種膠責任普遍失究;天然橡膠種植生態(tài)保護法治缺陷根本上是由于天然橡膠的法律屬性與生態(tài)屬性的矛盾,如森林屬性與生態(tài)脆弱性之矛盾,經(jīng)濟林屬性與生態(tài)效益之矛盾;為此應完善天然橡膠種植的生態(tài)保護立法,建立科學、合理的天然橡膠種植保障制度,強化生態(tài)監(jiān)管,健全生態(tài)調(diào)控機制,加大非法種膠的法律責任。
[Abstract]:Natural rubber planting caused serious ecological problems, but the rubber plantation ecological protection law has many defects, including ecological risk prevention legislation is imperfect, it is difficult to effectively implement the ecological regulation, a serious lack of ecological control mechanism, a widespread failure of the responsibility of deforestation rubber; natural rubber planting ecological protection law is fundamentally flawed because the contradiction of legal property and the ecological properties of natural rubber, such as forest attributes and ecological frangibility of contradiction, the contradiction between economic and ecological benefits of forest property; therefore we should perfect the legislation of protecting ecology of natural rubber plantations, the establishment of a scientific and reasonable planting natural rubber security system, strengthen ecological regulation, improve the ecological regulation mechanism, increase the legal liability of the illegal gum.
