【摘要】：近些年來(lái)，，食品安全領(lǐng)域的事故頻繁發(fā)生，“蘇丹紅事件”、“雀巢嬰幼兒奶粉轉(zhuǎn)基因事件”、“立頓茶氟超標(biāo)事件”、“金華敵敵畏火腿事件”“三聚氰胺事件”、“地溝油”事件，個(gè)個(gè)都觸目驚心，一件件的食品安全事故讓我們不得不對(duì)食品安全監(jiān)管體制進(jìn)行反思。在我們抨擊企業(yè)的違法行為時(shí)，對(duì)政府的行政問(wèn)責(zé)也悄然開(kāi)始。2003年的“非典事件”標(biāo)志著我國(guó)開(kāi)始全面推行行政問(wèn)責(zé)制。然而，在我國(guó)食品安全監(jiān)管領(lǐng)域的行政問(wèn)責(zé)制度并不是非常健全，因此，在理論上研究和探討食品安全監(jiān)管領(lǐng)域的行政問(wèn)責(zé)制度具有重要的理論和現(xiàn)實(shí)意義。本文共分為二部分，第一部分是緒論，緒論部分主要包括文章選題的目的和意義、國(guó)內(nèi)外研究現(xiàn)狀、研究的主要內(nèi)容、研究方法與創(chuàng)新。第二部分分為三章，第一章從食品安全監(jiān)管和食品安全監(jiān)管中的行政問(wèn)責(zé)制兩個(gè)方面進(jìn)行闡述，界定了食品安全、食品安全監(jiān)管、行政問(wèn)責(zé)的基本概念。明確了食品安全監(jiān)管的意義和食品安全監(jiān)管中行政問(wèn)責(zé)的重要意義。第二章分析了我國(guó)食品安全監(jiān)管中行政問(wèn)責(zé)的現(xiàn)狀及存在的問(wèn)題。第三章從改革食品安全監(jiān)管機(jī)構(gòu)、食品安全監(jiān)管中行政問(wèn)責(zé)的程序與救濟(jì)以及建立健全食品安全監(jiān)管中行政問(wèn)責(zé)的相關(guān)配套制度三個(gè)方面來(lái)談如何構(gòu)建我國(guó)食品安全監(jiān)管中行政問(wèn)責(zé)機(jī)制。
[Abstract]:In recent years, the field of food safety accidents occur frequently, "tonyred", "Nestle transgenic infant milk powder incident", "Lipton tea fluoride exceed the standard event", "Jinhua ham dichlorvos incident" "melamine incident", "drainage oil" incident, all contact shocking food safety accidents, so we have a piece of reflection on the food safety supervision system. If we attack their violations, the government administrative accountability has quietly started.2003 years of "SARS" marking the beginning of China's full implementation of the administrative accountability system in our country. However, in the field of food safety supervision of the administrative accountability system is not very perfect. Therefore, to study and explore the field of food safety supervision administration asked the responsibility system in theory has important theoretical and practical significance. This paper is divided into two parts, the first part is the introduction, introduction Part mainly includes the purpose and significance of this topic, the research status at home and abroad, the main research contents, research methods and innovation. The second part is divided into three chapters, the first chapter of the two aspects of the administrative accountability system from the supervision of food safety and food safety supervision is discussed in this paper, the definition of food safety, food safety supervision, the basic concept of administrative accountability. The importance of food safety supervision and food safety supervision in the administrative accountability. The second chapter analyzes the current situation of administrative accountability question in our country's food safety supervision and the existing problems. The third chapter leather from the food safety regulatory agencies, the food safety supervision administration asked the three aspects related the system of accountability procedures and relief and the establishment of food safety supervision in the administrative accountability system to discuss how to construct the mechanism of administrative accountability question in our country's food safety supervision.
