【摘要】：環(huán)境風(fēng)險(xiǎn)是指在環(huán)境領(lǐng)域，人為制造的環(huán)境危機(jī)出現(xiàn)、環(huán)境事件發(fā)生的可能性和概率，本文擬從環(huán)境風(fēng)險(xiǎn)的理論風(fēng)險(xiǎn)規(guī)制的正當(dāng)性理論入手，垃圾焚燒填埋場(chǎng)選址的環(huán)境風(fēng)險(xiǎn)，垃圾焚燒填埋場(chǎng)選址決策的正當(dāng)程序，垃圾焚燒填埋場(chǎng)選址的環(huán)境風(fēng)險(xiǎn)規(guī)制的制度完善。 本文第一部分主要從環(huán)境風(fēng)險(xiǎn)的概述引出垃圾焚燒填埋場(chǎng)選址的環(huán)境風(fēng)險(xiǎn)，包括兩個(gè)層面，第一層面是垃圾焚燒填埋場(chǎng)選址的風(fēng)險(xiǎn)類型，其中包括垃圾焚燒填埋場(chǎng)選址的監(jiān)管風(fēng)險(xiǎn)、自然環(huán)境風(fēng)險(xiǎn)以及社會(huì)穩(wěn)定風(fēng)險(xiǎn)，第二層面是環(huán)境風(fēng)險(xiǎn)法律規(guī)制的正當(dāng)性理論。 第二部分開始論述垃圾焚燒填埋場(chǎng)選址決策的正當(dāng)法律程序，包括四個(gè)層面，第一層面是垃圾焚燒填埋場(chǎng)選址的環(huán)境影響評(píng)價(jià)，其中包括環(huán)境污染問題專家的遴選和組成、可供選擇方案以及環(huán)境風(fēng)險(xiǎn)的防范措施。第二層面是垃圾焚燒填埋場(chǎng)選址決策的環(huán)境信息公開，其中包括三個(gè)階段的信息公開，分別是規(guī)劃立項(xiàng)階段的信息公開、環(huán)境影響評(píng)價(jià)階段的信息公開和環(huán)評(píng)審批結(jié)果的信息公開。第三層面是垃圾焚燒填埋場(chǎng)選址決策的公眾參與，和信息公開相同也包括三個(gè)階段分別是規(guī)劃立項(xiàng)階段的公眾參與、環(huán)境影響評(píng)價(jià)中的公眾參與和環(huán)評(píng)審批的公眾參與。第四層面是垃圾焚燒填埋場(chǎng)選址的審批程序，包括選址審批存在的問題以及選址審批的正當(dāng)程序。 第三部分主要是寫垃圾焚燒填埋場(chǎng)選址環(huán)境風(fēng)險(xiǎn)規(guī)制的制度完善，包括兩個(gè)層面，，第一層面是垃圾焚燒填埋場(chǎng)選址環(huán)境影響評(píng)價(jià)制度的完善，其中包括環(huán)境影響評(píng)價(jià)制度中的可供選擇方案的設(shè)立和專家的遴選和責(zé)任制度的完善。第二層面是垃圾焚燒填埋場(chǎng)環(huán)境風(fēng)險(xiǎn)防范政府責(zé)任的強(qiáng)化。
[Abstract]:The environmental risk refers to the possibility and probability of the man-made environmental crisis and the occurrence of the environmental event in the field of environment. This paper intends to start with the theory of the legitimacy of the regulation of the theoretical risk of the environmental risk and the environmental risk of the site selection of the refuse incineration landfill. The system of environmental risk regulation of MSW landfill site selection is perfect. The first part of this paper mainly introduces the environmental risk of landfill site selection from the overview of environmental risk, including two levels, the first level is the risk type of landfill site selection. It includes the supervision risk, the natural environment risk and the social stability risk of the landfill site. The second level is the legitimacy theory of the legal regulation of the environmental risk. The second part begins to discuss the due process of the site selection of MSW incineration landfill, including four levels, the first level is the environmental impact assessment of MSW landfill site location, including the selection and composition of environmental pollution experts. The second level is the environmental information disclosure of the landfill site location decision, which includes three stages of information disclosure, one is the information disclosure of the planning stage, and the other is the environmental risk prevention measure, the second level is the environmental information disclosure of the landfill site location decision, which includes three stages of information disclosure, one is the information disclosure in the planning stage. The third level is the public participation in the decision of the site selection of MSW incineration landfill site, and the same as the public information disclosure, which also includes three stages of public participation in the planning stage. Public participation in environmental impact assessment and public participation in EIA approval. 4th level is the approval process of landfill site location, including the existing problems and due process of site approval. The third part is mainly about the improvement of environmental risk regulation system of landfill site location, including two levels, the first level is the improvement of environmental impact assessment system of landfill site location. The second level is the strengthening of the government's responsibility for environmental risk prevention in MSW incineration landfills, including the establishment of alternative schemes in the EIA system, the selection of experts and the perfection of the liability system.
