【摘要】：研究乳制品安全監(jiān)管責(zé)任具有重要的理論價(jià)值,乳制品安全監(jiān)督中法律責(zé)任是法律義務(wù)和法律制裁之間的橋梁,是保障法律有效運(yùn)行,維護(hù)司法公正的關(guān)鍵環(huán)節(jié)。因此,良好地乳制品安全監(jiān)管中法律責(zé)任制度,對(duì)改善乳制品安全管理的現(xiàn)狀,推動(dòng)食品產(chǎn)業(yè)健康發(fā)展,維護(hù)社會(huì)的穩(wěn)定具有重大的意義。本文主要有三部分內(nèi)容。第一部分為乳制品安全監(jiān)管中法律責(zé)任的概述。主要是研究有關(guān)乳制品安全監(jiān)管中法律責(zé)任的一些基本問(wèn)題,包括四個(gè)方面的內(nèi)容：第一個(gè)方面內(nèi)容是乳制品安全監(jiān)管中法律責(zé)任基本概念；第二個(gè)方面是乳制品安全監(jiān)管中法律責(zé)任的內(nèi)涵；第三個(gè)方面是乳制品安全監(jiān)管中法律責(zé)任的功能與價(jià)值；第四個(gè)方面是我國(guó)乳制品安全監(jiān)管中法律責(zé)任的發(fā)展與現(xiàn)狀。通過(guò)對(duì)乳制品安全監(jiān)管中法律責(zé)任概念、內(nèi)涵、價(jià)值和現(xiàn)狀等的分析,可以明確的看出乳制品安全監(jiān)管中法律責(zé)任在行政法律制度中具有十分重要的地位。第二部分為我國(guó)乳制品安全監(jiān)管中法律責(zé)任存在的主要問(wèn)題。這一部分主要從乳制品安全監(jiān)管主體的責(zé)任與乳制品生產(chǎn)者、經(jīng)營(yíng)者的責(zé)任兩個(gè)方面來(lái)分析我國(guó)現(xiàn)有乳制品安全監(jiān)管中法律責(zé)任存在的問(wèn)題：一是監(jiān)管主體的責(zé)任立法不完善、責(zé)任承擔(dān)的主體不明確以及追責(zé)程序不嚴(yán)格,二是對(duì)生產(chǎn)者和經(jīng)營(yíng)者的處罰力度小,責(zé)任追究程序不完善。文中通過(guò)對(duì)出現(xiàn)這些問(wèn)題的現(xiàn)狀和原因進(jìn)行分析,為我國(guó)乳制品安全監(jiān)管中法律責(zé)任的完善提供理論基礎(chǔ)和實(shí)踐經(jīng)驗(yàn)。第三部分為我國(guó)乳制品安全監(jiān)管中法律責(zé)任的完善。在這一部分中,主要從二個(gè)個(gè)方面來(lái)對(duì)我國(guó)乳制品安全監(jiān)管中法律責(zé)任進(jìn)行完善。首先是完善乳制品安全監(jiān)管主體的法律責(zé)任,主要是針對(duì)監(jiān)管主體的職責(zé)、問(wèn)責(zé)制度和監(jiān)督機(jī)制提出完善措施；其次是完善乳制品生產(chǎn)者、經(jīng)營(yíng)者法律責(zé)任,主要是在加大懲罰力度和責(zé)任追究方式兩個(gè)方面來(lái)進(jìn)行完善。結(jié)語(yǔ)部分對(duì)文章進(jìn)行了總結(jié),進(jìn)一步闡述了完善乳制品安全監(jiān)管責(zé)任的必要性和迫切性。
[Abstract]:It is of great theoretical value to study the responsibility of dairy product safety supervision. The legal responsibility is the bridge between legal obligation and legal sanction, which is the key link to ensure the effective operation of the law and to maintain the judicial justice. A sound legal responsibility system in the supervision of dairy products safety will improve the present situation of dairy safety management and promote the healthy development of the food industry. It is of great significance to maintain social stability. There are three parts in this paper. The first part is an overview of the legal responsibility in the safety supervision of dairy products. It includes four aspects: the first aspect is the basic concept of legal responsibility in dairy product safety supervision, the second aspect is the connotation of legal responsibility in dairy product safety supervision. The third aspect is the function and value of the legal responsibility in the dairy product safety supervision, the fourth aspect is the development and the present situation of the legal responsibility in the dairy product safety supervision. Analysis of value and status, etc., It can be clearly seen that the legal responsibility of dairy product safety supervision has a very important position in the administrative legal system. The second part is the main problem of the legal responsibility in the dairy product safety supervision in our country. From the responsibility of the main body of dairy product safety supervision and the dairy product producer, This paper analyzes the problems existing in the legal responsibility of the current dairy product safety supervision in China from two aspects: the first is the imperfect legislation of the responsibility of the supervisor, the uncertainty of the subject of the responsibility and the lack of strict procedures for pursuing the responsibility. Second, the punishment of producers and operators is small, and the procedure of accountability is not perfect. In this paper, through the analysis of the present situation and causes of these problems, The third part is the perfection of the legal responsibility in the safety supervision of dairy products in China. Mainly from two aspects to perfect the legal responsibility of the dairy product safety supervision in our country. First of all, it is to perfect the legal responsibility of the main body of the dairy product safety supervision, mainly aiming at the responsibility of the supervision subject. Accountability system and supervision mechanism put forward perfect measures; secondly, perfect dairy producers and operators' legal responsibility, mainly in two aspects of increasing punishment and accountability. Further elaborated the consummation dairy product safety supervision responsibility necessity and the urgency.
