【摘要】：濕地與森林、海洋并稱為全球三大生態(tài)系統(tǒng),具有巨大的生態(tài)、經(jīng)濟(jì)和社會效益,是人類最重要的生態(tài)環(huán)境資本之一,是國家生態(tài)安全不可或缺的重要組成部分,是經(jīng)濟(jì)社會可持續(xù)發(fā)展的戰(zhàn)略基礎(chǔ)。加強(qiáng)濕地資源保護(hù),對于貫徹落實科學(xué)發(fā)展觀、促進(jìn)福建生態(tài)文明先行示范區(qū)建設(shè)具有重要意義。 本文從福建省情出發(fā),總結(jié)多年來濕地保護(hù)的經(jīng)驗教訓(xùn),借鑒國內(nèi)外濕地保護(hù)立法的研究成果和創(chuàng)新做法,探索福建省生態(tài)文明先行示范區(qū)建設(shè)中開展?jié)竦乇Ｗo(hù)立法的具體路徑和制度定位,為加強(qiáng)濕地資源保護(hù)與合理利用提供法治保障。 論文主體部分共分為濕地保護(hù)立法的現(xiàn)實需求、基本思路、主體框架和制度創(chuàng)新等四個部分。論文立足當(dāng)前福建省生態(tài)文明先行示范區(qū)建設(shè)戰(zhàn)略視域,較為全面地梳理了福建省濕地保護(hù)基本現(xiàn)狀,分析了通過立法保護(hù)福建省濕地資源的現(xiàn)實必要性和緊迫性,闡述了福建省生態(tài)文明先行示范區(qū)濕地保護(hù)立法的基本思路,進(jìn)一步提出福建省生態(tài)文明先行示范區(qū)濕地保護(hù)立法的主體框架,并論述了福建省生態(tài)文明先行示范區(qū)濕地保護(hù)立法的制度創(chuàng)新空間和嘗試,以期對福建省濕地保護(hù)有所助益。 論文的創(chuàng)新之處在于：一是從建設(shè)福建省生態(tài)文明先行示范區(qū)和建設(shè)法治社會的角度思考濕地保護(hù)立法問題,提出濕地保護(hù)立法的現(xiàn)實必要性、緊迫性,緊跟時代脈搏,選題具有新穎性；二是較為深入、全面梳理了濕地保護(hù)立法的有關(guān)問題,既有宏觀的理論分析,又有微觀的具體建議,實踐性、可操作性強(qiáng)；三是對濕地保護(hù)中的重點(diǎn)、難點(diǎn)問題進(jìn)行剖析,即緊密結(jié)合實際,又立足長遠(yuǎn),提出建設(shè)性的制度建議。
[Abstract]:Wetlands, forests and oceans are known as the three major ecosystems in the world. They have enormous ecological, economic and social benefits. They are one of the most important ecological environmental capital of mankind and an indispensable part of national ecological security. Strengthening the protection of wetland resources is of great significance for carrying out the scientific development view and promoting the construction of ecological civilization demonstration zone in Fujian. Based on the situation of Fujian Province, this paper summarizes the experience and lessons of wetland protection over the years, and draws lessons from the research results and innovative practices of domestic and foreign wetland protection legislation. This paper explores the specific path and system orientation of wetland protection legislation in the construction of ecological civilization first demonstration area in Fujian Province, and provides legal guarantee for strengthening the protection and rational utilization of wetland resources. The main body of the paper is divided into four parts: the realistic demand of wetland protection legislation, the basic idea, the main frame and the system innovation. This paper comprehensively combs the basic status of wetland protection in Fujian Province, analyzes on the necessity and urgency of protecting wetland resources in Fujian Province through legislation, and expounds the basic ideas of wetland protection legislation in the ecological civilization first demonstration area of Fujian Province. Furthermore, the main frame of wetland protection legislation of ecological civilization first demonstration area in Fujian Province is put forward, and the system innovation space and attempt of wetland protection legislation in Fujian ecological civilization first demonstration area are discussed in order to be helpful to the wetland protection in Fujian Province. The innovation of this paper lies in the following aspects: first, from the point of view of constructing the ecological civilization demonstration zone of Fujian Province and constructing the society ruled by law, the author thinks about the legislative issues of wetland protection, and puts forward the realistic necessity and urgency of the legislation of wetland protection, keeping up with the pulse of the times. The selection of the topic is novel; second, it thoroughly combs the relevant issues of wetland protection legislation, both macro theoretical analysis and micro specific suggestions, practicality, strong operability; third, the key points in wetland protection, Difficult problems are analyzed, that is, closely combined with reality, and based on the long-term, put forward constructive system suggestions.
