行政合同中行政優(yōu)先權(quán)行使問(wèn)題研究

【摘要】:摘要:隨著服務(wù)行政理念的發(fā)展,行政合同已逐步成為政府行政的重要方式。由于行政合同中行政色彩的“弱化”,行政主體基于公共利益享有行政優(yōu)先權(quán),較之傳統(tǒng)行政優(yōu)先權(quán)也形成了一種“弱化”,具有和傳統(tǒng)行政優(yōu)先權(quán)不同的特征。 行政合同中行政優(yōu)先權(quán)的正確行使,既關(guān)系到公共利益的實(shí)現(xiàn),也關(guān)系到相對(duì)人的正當(dāng)權(quán)益能否獲得保護(hù)。因此行政主體在行政合同中的行政優(yōu)先權(quán)不能任意行使,必須要有確定的行使原則和制度。一般而言,基于公共利益考慮是行政主體在行政合同中行使行政優(yōu)先權(quán)的基礎(chǔ)和前提,即只有當(dāng)公共利益遭受較大損失時(shí)才能行使。 行政合同作為權(quán)力意識(shí)和契約精神的契合,既具有契約性又具有行政性。行政合同行政性的一面表現(xiàn)在所有行政合同制度都應(yīng)該受到行政法的基本原則、基本理論的約束。行政主體在行政合同中行使行政優(yōu)先權(quán)也不例外,也應(yīng)該遵守行政法的基本原則。特別是正當(dāng)程序原則、公開原則和比例原則。正當(dāng)程序原則使得行政主體在行政合同中行使行政優(yōu)先權(quán)時(shí)必須符合程序正義的最低要求。公開原則使得相對(duì)人能夠參與行政合同中行政優(yōu)先權(quán)行使的整個(gè)過(guò)程,這對(duì)于保障相對(duì)人正當(dāng)權(quán)益極具意義。比例原則能夠限制行政主體在行政合同中濫用行政優(yōu)先權(quán),即在行使前必須做到必要的利益衡量。 原則和理論對(duì)實(shí)踐的指導(dǎo)具有抽象性,因此必須在其指導(dǎo)下要建立一系列具有操作性的具體制度。建立行政合同中行政優(yōu)先權(quán)行使的聽證制度,最大意義在于使得相對(duì)人能夠參與到?jīng)Q定行政優(yōu)先權(quán)行使的程序中來(lái)。建立行政合同中行政優(yōu)先權(quán)行使的告知與協(xié)商制度,是貫徹行政合同契約性的必然要求,體現(xiàn)了行政主體與相對(duì)人的合意。建立行政合同中行政優(yōu)先權(quán)行使的第三方評(píng)價(jià)制度,最大程度保證評(píng)價(jià)的客觀、真實(shí),從而抑制行政主體在行政合同中行使行政優(yōu)先權(quán)的任意性。 由于我國(guó),關(guān)于行政合同的理論和實(shí)踐尚不成熟,其中的行政優(yōu)先權(quán)行使的具體制度設(shè)計(jì)更是剛剛起步,只存在于一些學(xué)者的只言片語(yǔ)或輕描淡寫中,行政合同中行政優(yōu)先權(quán)行使制度亟待具體化、系統(tǒng)化,在具體制度構(gòu)建中,聽證制度、告知與協(xié)商制度、評(píng)價(jià)制度是不可回避的重要內(nèi)容,這對(duì)于正確行使行政優(yōu)先權(quán),維護(hù)相對(duì)人正當(dāng)權(quán)益具有重大意義。
[Abstract]:Abstract: with the development of the concept of service administration, the administrative contract has gradually become an important way of government administration. Due to the "weakening" of the administrative color in the administrative contract, the administrative subject enjoys the administrative priority based on the public interest. Compared with the traditional administrative priority, it has formed a kind of "weakening" and has different characteristics from the traditional administrative priority. The correct exercise of administrative priority in administrative contract is not only related to the realization of public interest, but also to whether the legitimate rights and interests of relative person can be protected. Therefore, the administrative priority of administrative subject in administrative contract cannot be exercised arbitrarily. Generally speaking, the consideration of public interest is the basis and premise for administrative subject to exercise administrative priority in administrative contract, that is, only when the public interest suffers a great loss can it be exercised. As a combination of the consciousness of power and the spirit of contract, administrative contract is both contractual and administrative. The administrative aspect of administrative contract is that all administrative contract systems should be subject to the basic principles of administrative law. The restriction of the basic theory. The administrative subject exercising the administrative priority in the administrative contract is no exception, and should abide by the basic principles of administrative law, especially the principle of due process, Principle of publicity and principle of proportionality. Due process principle makes it necessary for administrative subject to meet the minimum requirements of procedural justice when exercising administrative priority in administrative contract. The principle of openness enables counterpart to participate in the administration of administrative contract. The whole process of exercising priority, The principle of proportionality can limit the abuse of administrative priority by the administrative subject in the administrative contract, that is to say, the necessary benefits must be measured before exercising. The principles and theories are abstract to the practice, so we must establish a series of operable concrete systems under the guidance of the principles and theories, and establish the hearing system of the administrative priority in the administrative contract. The greatest significance lies in enabling the relative person to participate in the procedure of determining the exercise of administrative priority. It is an inevitable requirement to carry out the contractual nature of administrative contract to establish the system of notification and consultation for the exercise of administrative priority in administrative contract. It embodies the agreement of the administrative subject and the relative person. The third party evaluation system of the administrative priority in the administrative contract is established to ensure the objectivity and truth of the evaluation to the greatest extent. Therefore, the arbitrariness of administrative subject exercising administrative priority in administrative contract is restrained. Because of our country, the theory and practice of administrative contract are not mature, and the concrete system design of administrative priority exercise is just beginning, which only exists in some scholars' words or understatement. The system of exercising administrative priority in administrative contract is urgent to be concretized and systematized. In the construction of specific system, the system of hearing, informing and consultation, and evaluation system are the important contents that cannot be avoided, which is important for the correct exercise of administrative priority. It is of great significance to safeguard the legitimate rights and interests of the counterpart.
