【摘要】：死亡賠償金近年來廣受社會關(guān)注，一度成為熱點(diǎn)問題，而影響死亡賠償金數(shù)額多少的計(jì)算標(biāo)準(zhǔn)又是重中之重。現(xiàn)行法律文件中關(guān)于死亡賠償金計(jì)算標(biāo)準(zhǔn)的規(guī)定存在很多問題，其中以“城鄉(xiāng)戶籍”標(biāo)準(zhǔn)作為計(jì)算死亡賠償金的依據(jù)即是其中之一，這導(dǎo)致司法實(shí)踐中出現(xiàn)“同命不同價(jià)”現(xiàn)象1，受到公眾的廣泛詬病。本文通過對死亡賠償金計(jì)算標(biāo)準(zhǔn)的理論和我國相關(guān)的法律規(guī)定進(jìn)行分析，結(jié)合司法實(shí)踐，給出我國應(yīng)采用的計(jì)算標(biāo)準(zhǔn)，進(jìn)而對完善我國死亡賠償金計(jì)算標(biāo)準(zhǔn)提出相關(guān)建議。 本文共分為三章：第一章對死亡賠償金計(jì)算標(biāo)準(zhǔn)進(jìn)行了概述，首先對死亡賠償金計(jì)算標(biāo)準(zhǔn)的相關(guān)概念給與了介紹；隨后探討了死亡賠償金的性質(zhì)和范圍；最后介紹了死亡賠償金計(jì)算標(biāo)準(zhǔn)的兩種學(xué)說。第二章分析了我國死亡賠償金計(jì)算標(biāo)準(zhǔn)的現(xiàn)狀及存在的問題和根源，首先對現(xiàn)狀給予了介紹，通過一個(gè)案例引出了爭議問題“同命不同價(jià)”并簡要做了分析，簡述了我國死亡賠償金計(jì)算標(biāo)準(zhǔn)的相關(guān)法律規(guī)定；其次對我國死亡賠償金計(jì)算標(biāo)準(zhǔn)存在的問題進(jìn)行了分析，，從“城鄉(xiāng)戶籍”標(biāo)準(zhǔn)、受訴法院地和計(jì)算年限三方面存在的問題給與了分析；最后分析了我國死亡賠償金計(jì)算標(biāo)準(zhǔn)存在問題的根源。第三章在前面章節(jié)的基礎(chǔ)上對我國死亡賠償金計(jì)算標(biāo)準(zhǔn)的完善提出了建議，首先對域外死亡賠償金進(jìn)行了介紹和思考；其次在立法上對我國死亡賠償金提出了建議，指出死亡賠償金計(jì)算標(biāo)準(zhǔn)應(yīng)遵循的原則，指出死亡賠償金計(jì)算標(biāo)準(zhǔn)的思路為制定“分類賠償標(biāo)準(zhǔn)”，即以死者生前收入為依據(jù)的差額化為基礎(chǔ)，依據(jù)死者生前收入的不同劃分不同的類型群體，每種類型有自己的計(jì)算標(biāo)準(zhǔn)和方法；最后，也是本文的重點(diǎn)，對死亡賠償金計(jì)算標(biāo)準(zhǔn)從以實(shí)際收入作為計(jì)算的基礎(chǔ)標(biāo)準(zhǔn)、以特定群體的固定標(biāo)準(zhǔn)為內(nèi)容、設(shè)置合理的計(jì)算年限與設(shè)置最低和最高賠償限額四個(gè)方面給以了具體的建議。
[Abstract]:In recent years, death compensation has been widely concerned by the society, and has once become a hot issue, and the standard that affects the amount of death compensation is the most important one. There are many problems in the provisions of the current legal documents on the standard of calculating death compensation. Among them, the criterion of "urban and rural household registration" is used as the basis for calculating the compensation for death. This has led to the phenomenon of "same life and different price" in judicial practice, which has been widely criticized by the public. This paper analyzes the theory of death compensation calculation standard and the relevant laws and regulations of our country, and combines with judicial practice. The standard of calculation should be adopted in our country, and some suggestions on perfecting the standard of death compensation in China are put forward. This paper is divided into three chapters: the first chapter gives an overview of the criteria for calculating death compensation, first introduces the related concepts of death compensation standard, and then discusses the nature and scope of death compensation. At last, it introduces two theories of death compensation calculation standard. Chapter two analyzes the present situation, existing problems and root causes of death compensation calculation standard in China, first of all, it introduces the present situation. Through a case, this paper leads to the controversial issue of "the same life different price" and makes a brief analysis, briefly describes the relevant legal provisions of the death compensation calculation standard of our country; secondly, it analyzes the problems existing in the standard of death compensation calculation in our country. From the "urban and rural household registration" standards, the subject of the court and the calculation of three aspects of the existence of the problems given to the analysis; Finally, it analyzes the root cause of the problems in the standard of death compensation calculation. Chapter three puts forward some suggestions on the perfection of the standard of death compensation in China on the basis of the previous chapters. Firstly, the author introduces and thinks about the death compensation abroad. Secondly, it puts forward some suggestions on the death compensation in our country, and points out the principles to be followed in the calculation standard of death compensation. It is pointed out that the idea of calculating standard of death compensation is to make "classified compensation standard", that is, the difference based on the deceased's antemormal income is the basis, and different types of groups are divided according to the different income of the deceased. Each type has its own criteria and methods of calculation; finally, it is also the focus of this paper, where the criteria for calculating death compensation are based on actual income and are based on fixed criteria for specific groups. Specific suggestions are given in four aspects: setting reasonable calculation years and setting minimum and maximum compensation limits.
