【摘要】：依法治軍從嚴治軍是我軍在長期的歷史發(fā)展中形成的具有我軍特色的基本治軍方略,它對于建設(shè)一支聽黨指揮、能打勝仗、作風(fēng)優(yōu)良的軍隊具有重要的推動作用。依法治軍從嚴治軍是黨建軍治軍的基本方略、強軍之基、依法治國的有機組成部分,它經(jīng)歷了思想的萌芽、正式提出、鞏固發(fā)展和提煉升華四個階段。把依法治軍從嚴治軍提高到強軍之基的戰(zhàn)略高度既是治軍思想的深化,也是法治思想在軍隊領(lǐng)域的深化。依法治軍從嚴治軍通過30年的實踐已經(jīng)逐步形成了一套內(nèi)容體系,黨的十八屆四中全會對該體系進行了詳細的闡述,而實踐內(nèi)容背后的理論支撐也在隨之逐步生根、發(fā)展。依法治軍從嚴治軍的體系包括實踐體系和理論體系,實踐體系由軍事立法、軍事執(zhí)法、軍事司法、軍事法制人才隊伍等構(gòu)成,其理論體系由制度、人才和運行三大要素構(gòu)成。依法治軍從嚴治軍的體系內(nèi)容既有歷史的沉淀,也有根據(jù)法治原則所進行的積極構(gòu)建,并且實踐體系和理論體系之間存在著良性互動關(guān)系,兩者都存在著不斷發(fā)展和完善的問題。。
[Abstract]:The army is the army strictly formed in the long history of the characteristics of our army basic military strategy, it is for the construction of a command of the party, to win the war, has an important role in promoting the fine style of the army. Army strictly is the basic strategy of the party army, army base, organic part of the rule of law, it has experienced the germ of the idea, formally proposed, consolidate and develop and refine four stages. To deepen the law to raise the army strictly to the strategic height is the base of a strong army military thought, and thought of the rule of law in the military field. The deepening of the army strictly through 30 years of practice has been gradually formed a set of content system of the party in the fourth Plenary Session of the 18th CPC Central Committee, this paper elaborates on the theory and practice of the content system, support behind the also gradually rooting, development law. The army strictly system includes practice system and theoretical system, practice system by military legislation, military law, military justice, a military legal personnel, its theoretical system by system, personnel and operation constitute the three elements. The content system of army strictly is the history of precipitation, and according to the positive construction of rule of law the principle of practice, and between system and theoretical system there is a benign interaction, both exist in the continuous development and improvement of the problem.
