【摘要】：隨著網(wǎng)絡(luò)空間的高速發(fā)展,如今網(wǎng)絡(luò)空間信息安全的保護(hù)成為了世界各國普遍關(guān)注的重要問題。信息網(wǎng)絡(luò)發(fā)展的宏觀經(jīng)濟(jì)環(huán)境和法治環(huán)境是網(wǎng)絡(luò)空間發(fā)展的“硬基礎(chǔ)”和“軟環(huán)境”,也是衡量網(wǎng)絡(luò)空間安全和國家信息安全的重要指標(biāo)。因此,完善相關(guān)立法以保障網(wǎng)絡(luò)空間和信息安全已經(jīng)成為國際共識。當(dāng)前,我們黨和國家高度重視網(wǎng)絡(luò)安全工作,2016年11月7日,在“總體國家安全觀”的背景下,《網(wǎng)絡(luò)安全法》正式公布。這標(biāo)志著我國網(wǎng)絡(luò)空間立法進(jìn)入了更高速的發(fā)展階段,然而網(wǎng)絡(luò)空間所囊括的范圍是普遍又復(fù)雜的,網(wǎng)絡(luò)空間安全包含現(xiàn)實(shí)物理世界中的諸多方面的安全問題。本文正文共分五部分。開篇主要對網(wǎng)絡(luò)空間與國家信息安全的內(nèi)涵進(jìn)行簡要敘述,先分別介紹網(wǎng)絡(luò)空間的概念、特點(diǎn)、基本法律屬性與國家信息安全的內(nèi)涵,接著論述了網(wǎng)絡(luò)空間中國家信息安全面臨的風(fēng)險(xiǎn)和挑戰(zhàn)。這一部分是對全文重要概念的厘定和邏輯結(jié)構(gòu)的闡述。第二部分主要論述了保障網(wǎng)絡(luò)空間安全的立法基礎(chǔ),包括保障網(wǎng)絡(luò)空間安全的基本法律價值和特有法律價值兩個方面,基本法律價值包括平等、秩序和自由,而特有法律價值則是開放與共享、安全與發(fā)展。通過這一部分的論述,為網(wǎng)絡(luò)空間立法提供理論支撐和方向指導(dǎo)。第三部分從理論轉(zhuǎn)向?qū)嵺`,介紹了美國和俄羅斯兩個國家網(wǎng)絡(luò)空間立法的概況且簡要評析,立法概況部分總結(jié)歸納了其立法指導(dǎo)方針、立法目標(biāo)和立法內(nèi)容,這部分旨在總結(jié)國外的相關(guān)立法實(shí)踐,結(jié)合我國的相關(guān)立法現(xiàn)狀以及問題,借鑒國外立法先進(jìn)的經(jīng)驗(yàn)以完善我國的'網(wǎng)絡(luò)空間立法。第四部分論述了我國網(wǎng)絡(luò)空間立法面臨的問題,分為我國網(wǎng)絡(luò)空間安全的立法保護(hù)現(xiàn)狀與面臨問題兩部分,通過現(xiàn)狀來總結(jié)問題。立法保護(hù)現(xiàn)狀主要介紹了目前我國網(wǎng)絡(luò)空間的相關(guān)立法概況,重點(diǎn)介紹了《國家網(wǎng)絡(luò)空間安全戰(zhàn)略》、《網(wǎng)絡(luò)安全法》、《國家安全法》以及《保密法》四部具有代表性的法律和文件,進(jìn)而總結(jié)出了立法面臨的問題主要有三方面,分別為——國家信息安全的保護(hù)理念不夠明確、保護(hù)制度不完善以網(wǎng)絡(luò)空間國際合作機(jī)制不足。這部分總結(jié)的問題是后文提出完善建議的重要依據(jù)。第五部分是完善我國網(wǎng)絡(luò)空間立法的思考,這里在前述內(nèi)容的基礎(chǔ)上從保護(hù)國家信息安全的角度針對我國網(wǎng)絡(luò)空間安全立法提出了幾點(diǎn)思考和建議,首先在宏觀上明確我國網(wǎng)絡(luò)空間立法取向;接著要完善具體立法內(nèi)容,包括完善關(guān)鍵信息基礎(chǔ)設(shè)施保護(hù)立法、網(wǎng)絡(luò)安全審查立法、網(wǎng)絡(luò)安全等級保護(hù)立法以及構(gòu)建重點(diǎn)崗位和人員的特殊管理機(jī)制;最后要加強(qiáng)網(wǎng)絡(luò)空間國際合作與交流,共同制定網(wǎng)絡(luò)空間保護(hù)相關(guān)法律制度的國際規(guī)范。
[Abstract]:With the rapid development of network, network security protection now spatial information has become an important issue of common concern of all countries in the world. The development of information network of macro economic environment and the legal environment is the network space development of the "hard foundation" and "soft environment", but also an important indicator to measure the network space security and national information security. Therefore to improve the relevant legislation, to ensure network and information security has become an international consensus. At present, our party and the country attaches great importance to network security, in November 7, 2016, in the background of the overall view of national security "," network security law "officially announced. This marks the network space legislation in China has entered a stage of development speed however, the scope of network space includes is a common and complex, network security space contains many aspects of security problems in the physical world. This text Is divided into five parts. At the beginning of the main content of the network space and national information security are briefly described, first introduced the concept of network space, characteristics, basic connotation of legal property and the national information security, and then discusses the risks and challenges of information security China home network space. This part is on the important concepts the definition and logic structure in this paper. The second part mainly discusses the foundation of legislation to protect the security of cyberspace, two aspects including the basic value of law to protect the security of cyberspace and the unique legal value, the basic legal value including equality, order and freedom, and the unique legal value is the opening and sharing through security and development. This part provides theoretical support, guidance and direction for the network space legislation. The third part introduces the theory to practice from the United States and Russia, the two national network Overview of space legislation and brief comments, legislative overview part summarizes the legislative guidelines, legislation goal and content of this part is to summarize the relevant foreign legislative practice, combined with China's legislative status and problems, learn from foreign advanced experience to perfect the legislation of cyberspace legislation in China. The fourth part 'the face of China's cyberspace legislation, is divided into two parts with the problems of legislative protection of China's cyberspace security, through the present situation to summarize the problem. Current legislative protection mainly introduced the related legislation of network space at present in our country, focuses on the "national cyberspace security strategy", "network security law of national security Law >, < > and < > confidentiality law four representative laws and documents, and then summarizes the three main aspects of legislative problems, respectively - countries The concept of protection of information security protection system is not clear enough, not perfect in cyberspace international cooperation mechanism. This part summarizes the problems is proposed after an important basis for suggestions. The fifth part is the perfection of network space legislation in our country, here based on foregoing contents from the point of view for the protection of National Security Information Network China's space safety legislation and puts forward some ideas and suggestions, firstly defined cyberspace legislation orientation; then to improve the specific content of the legislation, including the improvement of critical information infrastructure protection legislation, network security legislation, special management mechanism of network security protection legislation and the construction of key staff positions and finally; to strengthen the network space of international exchange and cooperation, common development of international norms in cyberspace protection legal system.
