【摘要】：本文以案例為切入點(diǎn)，通過(guò)梳理法律理論與司法實(shí)踐中的分歧，分析交通事故中車輛貶值損失賠償?shù)幕拘再|(zhì)和適用規(guī)則，并結(jié)合實(shí)務(wù)中的多方面難題，進(jìn)而提出構(gòu)建具體賠償制度的意見(jiàn)和建議。正文由四部分組成，第一部分，列舉審判實(shí)踐中的典型案例和基礎(chǔ)調(diào)研統(tǒng)計(jì)，然后通過(guò)梳理理論界贊成、反對(duì)與折中三種觀點(diǎn)，，提出問(wèn)題。第二部分，分析了產(chǎn)生前述分歧是因法律依據(jù)、價(jià)值傾向、責(zé)任主體、賠償尺度、估價(jià)鑒定五方面的深層次原因，從而論證出這類賠償屬于直接損失這一基本性質(zhì)和相應(yīng)的賠償規(guī)則，為解決問(wèn)題提供了方向。第三部分，將研究思路拓展到域外相關(guān)實(shí)踐，以及我國(guó)房屋、藝術(shù)品等其他貶值損害賠償實(shí)踐，甚至稅法等經(jīng)濟(jì)法學(xué)中的合理性成分，為解決司法實(shí)務(wù)難題提供多角度的參考。第四部分，從劃定賠償范圍、賠償標(biāo)準(zhǔn)與原則、完善法律依據(jù)、明確賠償主體和規(guī)范鑒定機(jī)構(gòu)配套設(shè)置五個(gè)方面，對(duì)此類賠償制度的構(gòu)建提出意見(jiàn)和建議。
[Abstract]:This paper takes the case as the breakthrough point, through combing the legal theory and judicial practice in the differences, this paper analyzes the basic character of the vehicle depreciation loss compensation and the applicable rules of traffic accidents, combined with a number of problems in practice, and then put forward the construction of compensation system specific comments and suggestions. The text consists of four parts, the first part, lists the typical the case research and statistics in the trial practice, and then combing the theory in favor of opposition and compromise the three point of view, put forward the question. The second part analyzes the differences are due to produce a legal basis, value tendency, the main responsibility, compensation scale, deep-seated reasons for evaluation of the five aspects, in order to demonstrate this kind of the direct loss compensation belongs to the basic properties and the corresponding compensation rules, provides the direction for solving the problem. The third part will expand research ideas to the domain and abroad practice, and our real Wu, art and other damage compensation practice of tax depreciation, even in the economic jurisprudence rationality of multi angle reference for solving the problem of judicial practice. The fourth part, from the delineation of the scope of compensation, compensation standards and principles, perfecting the legal basis, clear compensation main body and standardize the appraisal institutions supporting five aspects, puts forward on the compensation system of the comments and suggestions.
