【摘要】：我國作為一個有著幾千年農業(yè)文明的大國,農民權益的保護始終在人們的視線之內�，F(xiàn)階段我國將草原列在廣義的“土地”范圍之內,但畢竟牧民與農民,草原與耕地是不同的概念。草原承包經營權是指草原承包人通過承包而取得的對草原進行占有、使用和收益的權利。對于通過家庭承包方式取得的草原承包經營權,承包經營權人有依法流轉的權利。在法律上,草原承包經營權流轉所包含的范圍很廣,但是只有轉讓和互換才涉及權利轉移。雖然我國《農村土地承包法》、《物權法》、《土地登記辦法》以及剛剛出臺的《不動產登記暫行條例》對草原承包經營權的流轉登記有所涉及,但是相比之下,牧民權益的保護不像農民權益一樣受到人們的關注,因此筆者專門對草原承包經營權流轉登記加以研究,期望加快我國草原承包經營權流轉登記的法治化進程。本文第一部分首先研究了草原承包經營權流轉登記的內涵、性質以及作用。第二部分對我國草原承包經營權流轉登記制度的現(xiàn)狀加以分析,認為目前存在的主要問題是現(xiàn)行草原承包經營權流轉登記模式存在缺陷、草原承包經營權流轉登記審查方式不明確、草原承包經營權流轉登記錯誤救濟機制不健全、草原承包經營權流轉登記質量不高、草原承包經營權流轉登記信息不夠公開等。第三部分對草原承包經營權流轉登記提出若干建議,即草原承包經營權流轉登記應采取登記要件主義、草原承包經營權流轉登記應進行實質審查、健全草原承包經營權流轉瑕疵登記制度、提高草原承包經營權流轉登記質量、完善草原承包經營權流轉登記信息公開制度等。
[Abstract]:As a large country with thousands of years of agricultural civilization, the protection of farmers' rights and interests is always within the sight of people. At this stage, grassland is listed in the broad range of "land", but after all herdsmen and farmers. Grassland and cultivated land are different concepts. The contracted management right of grassland refers to the acquisition of grassland by contractors. The right of use and income. For the right of contracted management of grassland obtained by the way of family contract, the contractual operator has the right to transfer according to law. In law, the right to contract management of grassland contains a wide range of scope. But only the transfer and exchange of rights involves the transfer of rights, although China's "Rural Land contract Law", "property Law". The Land Registration measures and the newly issued interim regulations on Real Estate Registration involve the circulation and registration of the contractual management right of the grasslands, but by contrast. The protection of herdsmen's rights and interests is not the same as the rights and interests of farmers by people's attention, so I specifically study the transfer of grassland contractual management rights registration. The first part of this paper first studies the connotation of grassland contractual management right transfer registration. The second part analyzes the current situation of grassland contractual management right transfer registration system in China, and points out that the main problem is the defects of the current grassland contract management right transfer registration model. Grassland contractual management right transfer registration review is not clear, grassland contractual management rights circulation registration error relief mechanism is not perfect, grassland contractual management rights transfer registration quality is not high. The third part puts forward some suggestions on the registration of grassland contractual management right circulation, that is, the registration of grassland contractual management right circulation should adopt registration elements doctrine. The registration of grassland contractual management right should be examined substantially, the defective registration system of grassland contract management right circulation should be improved, and the quality of grassland contract management right circulation registration should be improved. Perfect grassland contract management right circulation registration information publicity system and so on.
