【摘要】：美國傳媒產(chǎn)業(yè)法律是分散型立法模式,可分為報(bào)刊圖書出版、互聯(lián)網(wǎng)、廣播電視等行業(yè)法以及知識(shí)產(chǎn)權(quán)、稅收等專項(xiàng)事務(wù)法。美國傳媒產(chǎn)業(yè)的分散型立法是以版權(quán)交易為機(jī)制,以版權(quán)法為中心的法律體系,具有自然形成型、市場(chǎng)機(jī)制型和法律傳統(tǒng)型的特點(diǎn)。研究美國傳媒產(chǎn)業(yè)立法模式可為我國提供批判性的借鑒,即要堅(jiān)持根據(jù)我國的歷史發(fā)展、法律傳統(tǒng)等現(xiàn)實(shí)國情,找到適宜的中國傳媒產(chǎn)業(yè)立法模式;堅(jiān)持建立市場(chǎng)"無形之手"和政府"有形之手"協(xié)同的傳媒產(chǎn)業(yè)法律體系。
[Abstract]:American media industry law is a decentralized legislative model, which can be divided into newspaper and book publishing, Internet, radio and television industry law and intellectual property rights. The decentralized legislation of the media industry in the United States is based on the mechanism of copyright transaction and the copyright law as the center of the legal system, and it has a natural formation type. The study of the legislation model of American media industry can provide a critical reference for our country, that is, we should adhere to our country's historical development, legal tradition and other realistic conditions. To find the appropriate legislation model of Chinese media industry; Adhere to the establishment of the market "invisible hand" and the government "tangible hand" coordinated media industry legal system.
