【摘要】：2005年3月1日起正式施行的《宗教事務(wù)條例》(以下簡稱《條例》)填補(bǔ)了宗教事務(wù)引導(dǎo)與治理在國家層面的立法空白,是改革開放以來黨的宗教政策在制度方面的總結(jié),并成為10年來保障宗教信仰自由、維護(hù)民族團(tuán)結(jié)與社會(huì)穩(wěn)定的重要法規(guī)。然而宗教格局和社會(huì)現(xiàn)實(shí)的改變使得宗教事務(wù)規(guī)范方面的不完善逐漸暴露,規(guī)范與規(guī)范、規(guī)范與現(xiàn)實(shí)的沖突和矛盾顯現(xiàn)�！稐l例》實(shí)施10年以來,以之為核心的政策法規(guī)體系主要由兩個(gè)方面組成,一是國家宗教事務(wù)局及相關(guān)部委制定的規(guī)章政策,二是地方各級(jí)政府(主要為省級(jí))依據(jù)《條例》制定的省級(jí)宗教事務(wù)條例。從體例結(jié)構(gòu)和內(nèi)容兩個(gè)方面總結(jié)地方性規(guī)范的亮點(diǎn)和缺陷,在各地的宗教事務(wù)實(shí)踐當(dāng)中發(fā)現(xiàn)一些符合當(dāng)?shù)匦枨蟮男碌呐e措或者對(duì)舊有體系進(jìn)行突破性的嘗試,對(duì)于其中符合社會(huì)發(fā)展潮流和廣大人民意愿、在實(shí)踐中又確實(shí)收效良好的新舉措進(jìn)行探究,有助于總結(jié)宗教立法的不足。借鑒現(xiàn)有立法成果提出對(duì)《條例》修訂的建議,有助于堅(jiān)持科學(xué)立法,保障宗教信仰自由。
[Abstract]:Since March 1st 2005, the regulations on religious Affairs (hereinafter referred to as "regulations") have filled the legislative gaps in guiding and governing religious affairs at the national level. Since the reform and opening up, the Party's religious policy in the system of summary, and become 10 years to protect the freedom of religious belief. The important laws and regulations to maintain the national unity and social stability. However, the changes of religious pattern and social reality make the imperfections of religious affairs gradually exposed, norms and norms. Since the implementation of the "regulations" 10 years ago, the system of policies and regulations with the core as the core is mainly composed of two aspects: one is the regulations and policies formulated by the State Bureau of religious Affairs and the relevant ministries and commissions. Second, local governments at all levels (mainly provincial) according to the "regulations" formulated provincial religious affairs regulations, from the style structure and content of the two aspects of local norms summed up the bright spots and shortcomings. In the practice of religious affairs in various places, we found some new measures that meet the local needs or a breakthrough attempt on the old system, which is in line with the trend of social development and the wishes of the broad masses of the people. In practice, it is helpful to summarize the shortcomings of religious legislation by exploring the new measures with good results in practice. To use the existing legislative achievements for reference, to put forward the suggestion of amending the regulations, and to adhere to the scientific legislation. Freedom of religious belief is guaranteed.
