【摘要】：傳染病嚴重威脅人類健康,完善的法律制度是預防、控制、消除傳染病的保障。預防、控制、消除傳染病不僅需要科學技術的支撐,更需要法律制度的保障。傳染病防治法是調整預防、控制和消除傳染病的發(fā)生和流行,保障人體健康活動中產生的各種社會關系的法律法規(guī)的總和。為了預防、控制和消除傳染病的發(fā)生與流行,保障人體健康和公共衛(wèi)生,我國進行了許多傳染病方面的立法工作,逐步完善傳染病防治法律制度。2003年“非典”疫情后,2004年我國修訂了《中華人民共和國傳染病防治法》,并出臺多項配套法規(guī)、規(guī)章,使各項傳染病防治法律制度得以改進,然而在實踐過程中也暴露出一些問題,本文即是從衛(wèi)生法律的角度對傳染病防治法律制度進行分析,通過比較和邏輯分析等方法找出其中主要存在的問題,進而提出解決和完善的方法。 正文分三部分,即我國的傳染病防治法律制度綜述,傳染病防治法律制度的不足,完善傳染病防治法律制度的建議。 第一部分,對我國現(xiàn)有傳染病防治相關的法律法規(guī)進行綜合概述。主要闡述我國傳染病防治主要立法以及法律制度的變遷,并對現(xiàn)有的傳染病防治相關法律法規(guī)和法律制度加以介紹。 第二部分,著重分析我國現(xiàn)行傳染病防治法律制度的不足。主要概括分析現(xiàn)行傳染病相關法律、法規(guī)和規(guī)章的不足,進一步從傳染病疫情控制與應急處理、消毒產品監(jiān)管、醫(yī)療廢物管理、衛(wèi)生監(jiān)督制度、行政法律責任規(guī)定等方面詳細分析現(xiàn)行傳染病防治法律制度的不足。 第三部分,針對現(xiàn)行傳染病防治法律制度的不足提出相應的法律、法規(guī)和規(guī)章完善建議和措施。首先概述了法律、法規(guī)和規(guī)章完善的必要性,并進一步從疫情控制與應急處理制度的完善、消毒產品監(jiān)管制度的完善、醫(yī)療廢物管理制度的完善、衛(wèi)生監(jiān)督制度的完善及行政法律責任規(guī)定的完善等方面加以詳細的闡述。
[Abstract]:Infectious diseases are a serious threat to human health. The perfect legal system is to prevent, control, eliminate the protection of infectious diseases. Prevention, control, elimination of infectious diseases not only need the support of science and technology. The law of prevention and control of infectious diseases is to adjust the prevention, control and elimination of the occurrence and prevalence of infectious diseases, to protect the human health activities generated in all kinds of social relations the sum of laws and regulations in order to prevent. To control and eliminate the occurrence and prevalence of infectious diseases and protect human health and public health, China has carried out a lot of legislation on infectious diseases. After the SARS epidemic in 2003, China revised the Law of the people's Republic of China on the Prevention and Control of Infectious Diseases on 2004, and issued a number of supporting laws and regulations. To improve the legal system of infectious disease prevention and control, however, in the process of practice also exposed some problems, this article is from the point of view of health law to analyze the legal system of prevention and control of infectious diseases. The main problems are found out by comparison and logic analysis, and the methods to solve and perfect them are put forward. The text is divided into three parts: the summary of the legal system of infectious disease prevention and control in China, the deficiency of the legal system for the prevention and control of infectious diseases, and the suggestions for perfecting the legal system of prevention and control of infectious diseases. The first part is a comprehensive overview of the existing laws and regulations related to the prevention and control of infectious diseases in China. It mainly expounds the changes of the main legislation and legal system of the prevention and control of infectious diseases in China. And the existing laws and regulations related to the prevention and control of infectious diseases and legal system are introduced. The second part focuses on the analysis of the deficiencies of the current legal system of infectious disease prevention and control. The main analysis of the current infectious disease related laws, regulations and regulations deficiencies, further from the epidemic situation control and emergency treatment of infectious diseases. The deficiencies of the current legal system for the prevention and control of infectious diseases are analyzed in detail from the aspects of disinfection product supervision, medical waste management, sanitary supervision system and administrative legal liability. The third part, aiming at the deficiency of the current legal system of prevention and control of infectious diseases, puts forward the corresponding suggestions and measures to improve the laws, regulations and regulations. Firstly, it outlines the necessity of perfecting the laws, regulations and regulations. And further from the epidemic situation control and emergency management system, disinfection products supervision system, the improvement of medical waste management system. The improvement of health supervision system and the perfection of administrative legal liability are elaborated in detail.
