【摘要】：土地作為一種重要的農(nóng)業(yè)生產(chǎn)要素，合理、順暢地流通直接影響到土地資源的有效利用。因此，土地流轉(zhuǎn)一直是學者們永恒的研究課題。我國進入城鎮(zhèn)化進程快速發(fā)展的時期，土地流轉(zhuǎn)成為備受關(guān)注的焦點。2012年12月31日日出臺的“中央一號”文件提出打破城鄉(xiāng)二元制結(jié)構(gòu)的壁壘，進一步推進城鄉(xiāng)一體化進程，這樣以來農(nóng)村土地制度成為突破點。因此，研究農(nóng)村土地流轉(zhuǎn)對于尋找實現(xiàn)新農(nóng)村建設，促進全面建設小康社會的新路徑、新探索具有十分重大的意義。 圍繞農(nóng)村土地流轉(zhuǎn)制度及監(jiān)管，，本文共分四個部分： 第一章農(nóng)村土地流轉(zhuǎn)的背景。本章通過對農(nóng)村土地制度的梳理闡釋了土地流轉(zhuǎn)的必然性和現(xiàn)實意義，以及土地流轉(zhuǎn)的實現(xiàn)形式。 第二章農(nóng)村土地流轉(zhuǎn)的現(xiàn)狀。在農(nóng)村土地流轉(zhuǎn)已有一定規(guī)模的前提下，土地流轉(zhuǎn)過程中暴露的問題越來越突出，涉及的范圍也更廣。 第三章農(nóng)村土地流轉(zhuǎn)需要行政監(jiān)管。本章就農(nóng)村土地流轉(zhuǎn)中產(chǎn)生的問題，以農(nóng)村土地權(quán)利的行使和行政監(jiān)管的理論為基點，分析土地流轉(zhuǎn)必須要有行政監(jiān)管作為保障。 第四章農(nóng)村土地流轉(zhuǎn)的監(jiān)管建議。本章針對土地流轉(zhuǎn)現(xiàn)狀和理論分析，從土地產(chǎn)權(quán)制度的完善和加強政府的監(jiān)督管理能力方面，提出規(guī)范土地流轉(zhuǎn)的監(jiān)管建議。
[Abstract]:As an important factor of agricultural production, the rational and smooth circulation of land has a direct impact on the effective use of land resources. Land transfer has been an eternal research topic for scholars. China has entered a period of rapid development of urbanization. Land transfer has become the focus of attention. On December 2012, the "Central Committee No. 1" document proposed to break the barriers of urban-rural dual structure, and further promote the process of urban-rural integration. Therefore, it is of great significance to study the circulation of rural land to find a new way to realize the construction of new countryside and to promote the construction of a well-off society in an all-round way. Around the rural land circulation system and supervision, this paper is divided into four parts: The first chapter is the background of the rural land circulation. This chapter explains the inevitability and practical significance of the land circulation and the realization form of the land circulation by combing the rural land system. The second chapter is the current situation of rural land circulation. Under the premise of a certain scale of rural land circulation, the problems exposed in the process of land circulation are more and more prominent and the scope involved is wider. The third chapter of rural land transfer needs administrative supervision. This chapter on the rural land transfer problems, based on the exercise of rural land rights and the theory of administrative supervision. The analysis land circulation must have the administrative supervision as the safeguard. This chapter aims at the present situation and theoretical analysis of land circulation, from the aspects of perfecting the land property right system and strengthening the supervision and management ability of the government. Put forward regulation of land circulation regulatory recommendations.
