【摘要】：農(nóng)民工為我國經(jīng)濟(jì)、社會的發(fā)展做出了巨大貢獻(xiàn),是我國經(jīng)濟(jì)、政治、文化建設(shè)不可或缺的力量。然而這樣一個數(shù)量龐大的、為國家建設(shè)貢獻(xiàn)巨大的群體至今仍處在城市的邊緣位置,無法享受與城市市民同等待遇,其合法權(quán)益得不到有效保障,不僅影響著社會公平正義的實現(xiàn),而且成為構(gòu)建和諧社會進(jìn)程中必須解決的難題。伴隨著我國工業(yè)化和城鎮(zhèn)化的快速發(fā)展,農(nóng)民工權(quán)益保護(hù)問題也出現(xiàn)了的變化。富士康科技集團(tuán)成都科技園,成都市高新西區(qū)出口加工區(qū)(郫縣合作鎮(zhèn)),廠區(qū)面積10平方公里,員工近8萬人,其中絕大部分是農(nóng)民工。近些年有關(guān)富士康的報道有很多,大部分都涉及到農(nóng)民工權(quán)益受侵害的內(nèi)容。本文通過親身實踐,以富士康農(nóng)民工真實生活為研究背景,權(quán)益受侵害事件為素材,對農(nóng)民工權(quán)益保護(hù)過程中存在的問題進(jìn)行研究,得出相應(yīng)的結(jié)論。全文共有部分內(nèi)容。第一部分為前言,主要闡明了選題背景和選題意義、國內(nèi)外研究動態(tài)綜述、研究思路與方法、論文的創(chuàng)新點(diǎn)與不足。第二部分是全文的理論基礎(chǔ),主要對農(nóng)民工、新生代農(nóng)民工、農(nóng)民工權(quán)益的概念進(jìn)行拓展,對農(nóng)民工以及農(nóng)民工權(quán)益的概念有一個全面的認(rèn)識；隨后梳理了憲法平等權(quán)理論、馬斯洛需求理論、傳統(tǒng)哲學(xué)思想,為下文的問題分析提供理論支撐。第三部分主要對農(nóng)民工權(quán)益保護(hù)的現(xiàn)實狀況進(jìn)行總結(jié),從中找出農(nóng)民工權(quán)益保護(hù)過程中存在的問題。第四部分主要是對農(nóng)民工權(quán)益保護(hù)問題進(jìn)行歸納、研究和分析。第五部分分析得出現(xiàn)階段保護(hù)農(nóng)民工權(quán)益的思路和途徑。通過研究、分析主要得出以下結(jié)論：(1)當(dāng)前我國農(nóng)民工權(quán)益保障總體有所改善,但仍然存在維權(quán)問題,主要表現(xiàn)在農(nóng)民工的就業(yè)生存權(quán)到侵害、人身安全不被重視、政治政治尊嚴(yán)無法得以體現(xiàn),農(nóng)民工的社會權(quán)益保障乏力、缺乏社會認(rèn)同感。(2)對影響農(nóng)民工權(quán)益保障的不同因素分析發(fā)現(xiàn)：城鄉(xiāng)二元的戶籍制度、就業(yè)制度是導(dǎo)致農(nóng)民工權(quán)益受損的制度性根源；農(nóng)民工維權(quán)的法律意識淡薄,甚至缺乏維權(quán)意識,是農(nóng)民工權(quán)益維得不到保護(hù)的重要要原因；除了保障農(nóng)民工權(quán)益的法制不健全外,政府沒有起到相應(yīng)的保護(hù)作用也是農(nóng)民工權(quán)益受損的關(guān)鍵因素；不平等的勞動力市場、不平衡的供求關(guān)系以及企業(yè)責(zé)任感的欠缺是導(dǎo)致農(nóng)民工權(quán)益受損的直接原因；(3)在農(nóng)民工權(quán)益保障的過程中,鑒于農(nóng)民工權(quán)益的復(fù)雜性和保障難度,需要政府、企業(yè)、社會、農(nóng)民工自身等相關(guān)主體的共同努力,建立起全面、協(xié)調(diào)的農(nóng)民工權(quán)益保障政策體系。
[Abstract]:Migrant workers have made great contributions to the economic and social development of our country, which is an indispensable force in the economic, political and cultural construction of our country. However, such a large number of workers. The group that has contributed a lot to the national construction is still on the edge of the city, unable to enjoy the same treatment as the city citizen, and its legitimate rights and interests can not be effectively guaranteed, which not only affects the realization of social justice. With the rapid development of industrialization and urbanization, the protection of the rights and interests of migrant workers has also changed. Foxconn Science and Technology Group Chengdu Science and Technology Park. The export processing zone in Chengdu's Hi-tech Western District (Pixian Cooperative Town, 10 sq km) employs nearly 80,000 people, the vast majority of whom are migrant workers. There have been a lot of reports about Foxconn in recent years. Most of them are related to the rights and interests of migrant workers infringed on the content. Through personal experience, this paper takes the real life of Foxconn migrant workers as the research background, the rights and interests of the infringements as the material. The problems in the protection of migrant workers' rights and interests are studied, and the corresponding conclusions are drawn. The first part is the preface, which mainly explains the background and significance of the topic. The second part is the theoretical basis of the full text, mainly to expand the concept of migrant workers, the new generation of migrant workers, migrant workers' rights and interests. A comprehensive understanding of the concept of migrant workers and their rights and interests; Then combing the constitutional equality right theory Maslow demand theory traditional philosophical ideas for the following issues to provide theoretical support. The third part mainly summarizes the reality of the protection of migrant workers' rights and interests. Find out the problems in the process of protecting the rights and interests of migrant workers. 4th part is mainly to sum up the protection of the rights and interests of migrant workers. Research and analysis. 5th part of the analysis of the current stage of protection of the rights and interests of migrant workers thinking and approach. Through the study, the main conclusions are as follows: 1) the current protection of migrant workers' rights and interests in China has improved. However, there are still rights protection problems, mainly reflected in the migrant workers' right to survival to infringement, personal security is not attached importance to, political and political dignity can not be reflected, the social rights and interests of migrant workers lack of protection. Lack of social identity. 2) the analysis of different factors affecting the protection of migrant workers' rights and interests found that: urban and rural dual household registration system, employment system is the institutional cause of damage to the rights and interests of migrant workers; The weak legal consciousness and even the lack of awareness of the rights and interests of migrant workers is the important reason why the rights and interests of migrant workers can not be protected. Besides the imperfect legal system of protecting the rights and interests of migrant workers, the failure of the government to protect the rights and interests of migrant workers is also a key factor for the damage of the rights and interests of migrant workers. Unequal labor market, unbalanced supply and demand relationship and lack of corporate sense of responsibility are the direct reasons for the loss of the rights and interests of migrant workers. 3) in the process of protecting the rights and interests of migrant workers, in view of the complexity and difficulty of the protection of the rights and interests of migrant workers, it needs the joint efforts of the government, enterprises, society, migrant workers themselves and other relevant subjects to establish a comprehensive.
