【摘要】：隨著我國(guó)經(jīng)濟(jì)的迅速發(fā)展,城市街巷面貌日新月異。城市道路作為市政建設(shè)的基礎(chǔ)部分,其命名的規(guī)范化與城市建設(shè)、百姓生活息息相關(guān)。研究當(dāng)下的城市道路是否規(guī)范合法,存在哪些法律問題以及如何完善具有研究的理論價(jià)值與現(xiàn)實(shí)意義。我國(guó)有關(guān)道路命名的現(xiàn)行法律法規(guī)是1986年頒布的《地名管理?xiàng)l例》、1996年頒布的《地名管理?xiàng)l例實(shí)施細(xì)則》和各省市制定的《xx地名管理辦法》,法律法規(guī)已滯后于市政建設(shè),在命名主體、命名程序以及救濟(jì)方式等方面都存在諸多問題。本文的研究目的是探尋道路命名的規(guī)范化與法制化,筆者結(jié)合當(dāng)下的社會(huì)現(xiàn)狀,運(yùn)用了實(shí)地調(diào)研、文獻(xiàn)收集、比較研究等方法從法律法規(guī)、命名主體、命名程序、監(jiān)管機(jī)制、救濟(jì)方式等方面做了詳細(xì)的論述與分析,并借鑒國(guó)外命名的理論與實(shí)踐經(jīng)驗(yàn),為我國(guó)的道路命名提出了完善措施。文章分為六個(gè)部分,第一部分為緒論,主要介紹選題背景與研究意義、國(guó)內(nèi)外的研究現(xiàn)狀、本文的特色及創(chuàng)新之處。第二部分為概念的界定,文章論述的主體是城市道路,筆者對(duì)城市概念、道路的概念做了界定,并同公路和街道做了對(duì)比區(qū)分。第三部分總結(jié)了城市道路命名的五個(gè)原則。第四部分探討當(dāng)下城市道路命名存在的問題。第五部分為城市道路命名合法性分析,評(píng)論了我國(guó)道路命名的法律依據(jù),從行政法的角度論述了命名規(guī)范化所存在的缺失。同時(shí)簡(jiǎn)單探討了國(guó)外道路命名概況及對(duì)我國(guó)的實(shí)踐與經(jīng)驗(yàn)借鑒。第六部分著重從立法、執(zhí)法、監(jiān)管、救濟(jì)等方面提出了完善措施。
[Abstract]:With the rapid development of economy in our country, the appearance of urban streets is changing with each passing day. As the basic part of municipal construction, urban roads are standardized and urban construction. People's lives are closely related. To study whether the current urban road is legal or not. What legal problems exist and how to improve the theoretical value and practical significance of the study. The current laws and regulations on road naming in China are the "regulations on the Administration of Geographical names" promulgated in 1986. In 1996, the rules for the implementation of the regulations on the Administration of Geographical names and the measures for the Administration of xx Geographical names formulated by various provinces and cities, the laws and regulations have lagged behind the municipal construction, in naming subject. There are many problems in naming procedures and relief methods. The purpose of this paper is to explore the standardization and legalization of road naming. Combined with the current social situation, the author makes use of field research and literature collection. Comparative study and other methods from the laws and regulations, naming subjects, naming procedures, regulatory mechanisms, relief methods and other aspects of the detailed discussion and analysis, and learn from foreign naming theory and practical experience. The article is divided into six parts, the first part is the introduction, mainly introduces the background and significance of the topic, domestic and foreign research status. The second part is the definition of the concept. The main body of the article is the urban road. The author defines the concept of the city and the concept of the road. The third part summarizes the five principles of urban road naming. Part 4th discusses the existing problems of urban road naming. Part 5th analyzes the legitimacy of urban road naming. This paper reviews the legal basis of road naming in China. This paper discusses the deficiency of naming standardization from the angle of administrative law. At the same time, it discusses the general situation of road naming in foreign countries and the practice and experience of our country. Part 6th focuses on legislation, law enforcement and supervision. Remedies and other aspects of the proposed improvement measures.
