【摘要】：2011年1月21日，國務(wù)院《國有土地上房屋征收與補(bǔ)償條例》（國務(wù)院590號令，以下簡稱“《新條例》”）頒布實(shí)施以來，因公共利益而進(jìn)行的房屋征收項(xiàng)目陸續(xù)增多，國有土地房屋征收與集體土地房屋拆遷、農(nóng)村集體土地征用等行為并存。這些行為涉及建設(shè)單位、房屋所有權(quán)人、承租人的巨大利益，且工作程序環(huán)節(jié)多、自由裁量空間大、人為認(rèn)定情況多、公開透明度不高，缺乏相應(yīng)監(jiān)督，其侵權(quán)瀆職行為的預(yù)防和法律規(guī)制急待完善�！缎聴l例》雖然使征收從業(yè)人員性質(zhì)、資金管理、業(yè)務(wù)實(shí)施等在形式上發(fā)生了根本變化，但在原來房屋拆遷過程中，補(bǔ)償、安置、拆除、評估及資金監(jiān)管等環(huán)節(jié)容易發(fā)生的侵權(quán)瀆職行為，如利用職務(wù)便利徇私舞弊、濫用職權(quán)和玩忽職守等，并未因?yàn)椤缎聴l例》的出臺而得以遏制，反而有愈演愈烈的趨勢。因此，必須進(jìn)一步完善相關(guān)立法，完善監(jiān)督制約機(jī)制，以法律規(guī)制為主線，以紀(jì)律監(jiān)察為輔助，，通過明確房屋征收過程中各類違法行為的罪行罰則條款，從源頭上解決房屋征收領(lǐng)域侵權(quán)瀆職問題，以達(dá)到規(guī)范房屋征收行為，取信于民、還利于民的目的。
[Abstract]:On January 21st 2011, the regulations of the State Council on the Collection and compensation of Housing on State-owned Land (decree No. 590 of the State Council, hereinafter referred to as "the New regulations") have been promulgated and implemented. Due to the public interest, the number of housing expropriation projects has been increasing, state-owned land expropriation and collective land house demolition, rural collective land expropriation and other acts co-exist. These acts involve construction units, housing owners. The lessee's huge interest, and the work procedure link is many, the discretion space is big, the artificial confirmation situation is many, the public transparency is not high, lacks the corresponding supervision. The prevention of tort and dereliction of duty and the legal regulation are in urgent need of perfection. Although the new regulations make the nature of the levy practitioners, capital management, business implementation and other forms of fundamental changes have taken place. But in the original house demolition process, compensation, placement, demolition, evaluation and financial supervision and other links prone to tort and dereliction of duty, such as the use of duty to facilitate favoritism fraud, abuse of power and neglect of duty and so on. Not because of the "new regulations" and can be contained, on the contrary, there is a growing trend. Therefore, we must further improve the relevant legislation, improve the supervision and control mechanism, with legal regulation as the main line. With disciplinary supervision as the assistance, through the clear provisions of criminal penalties in the process of housing collection, from the source to solve the problem of tort and dereliction of duty in the field of housing collection, in order to standardize the housing expropriation behavior, to win the trust of the people. The purpose of benefiting the people.
