【摘要】：全面"二孩政策"在我國(guó)已經(jīng)落地,這可能使得女性的生育時(shí)間、生育成本比原來增加一倍,預(yù)示著女性在社會(huì)公共崗位上的工作時(shí)間縮短、經(jīng)濟(jì)負(fù)擔(dān)增大。如果女性參與社會(huì)勞動(dòng)時(shí)間縮短,可能導(dǎo)致其社會(huì)、家庭地位的下降。"二孩政策"的出臺(tái)不應(yīng)當(dāng)沖擊兩性平等的基本規(guī)則,包括兩性就業(yè)權(quán)的平等。如何在"二孩政策"背景下保護(hù)女性就業(yè)權(quán)成為立法必須做出回應(yīng)的問題。依據(jù)立法現(xiàn)狀與"就業(yè)歧視"現(xiàn)實(shí)的拷問,保護(hù)女性就業(yè)權(quán)立法層面存在立法理念待矯正、立法內(nèi)容過時(shí)須修正和完善等問題。分析問題產(chǎn)生的原因,應(yīng)從立法理念、立法原則、立法規(guī)則層面提出保護(hù)女性就業(yè)權(quán)立法的建議。
[Abstract]:The comprehensive "two-child policy" has already fallen to the ground in China, which may make women's birth time, birth cost more than double than before, foreshadowing a shorter working time for women in social public posts. If women's participation in society is shortened, it may lead to a decline in their social and family status. The introduction of the "two-child policy" should not impinge on the basic rules of gender equality. Including the equality of the right to employment of both sexes. How to protect women's right to employment under the background of "two-child policy" has become a problem that the legislation must respond to. According to the current situation of legislation and the reality of "employment discrimination" torture. There are some problems in the legislative aspect of protecting women's right to employment, such as the legislative idea to be corrected, the legislative content to be revised and perfected when the legislative content is too late, and so on. The analysis of the causes of the problems should be based on the legislative idea and the legislative principles. At the level of legislative rules, the author puts forward some suggestions on legislation to protect women's right to employment.
