我國私主體參與行政任務(wù)的行政法規(guī)制

【摘要】:在我國私主體參與行政任務(wù)的情形廣泛存在且不斷發(fā)展而傳統(tǒng)行政法規(guī)制乏力的當(dāng)下,盡快完善行政法對該領(lǐng)域的規(guī)制是當(dāng)務(wù)之急。從行政法視角出發(fā),結(jié)合我國實(shí)際,在借鑒國外私主體參與行政任務(wù)執(zhí)行理論的基礎(chǔ)上,分析論證更適合我國法律體系和實(shí)踐要求的折中主義規(guī)制模式,并以此模式為基礎(chǔ),將參與行政任務(wù)的私主體身份歸為被授權(quán)的私主體、被委托的私主體、行政助手和純粹私主體四種。在界定私主體參與行政任務(wù)的范圍問題上,主張采用消極排除法,結(jié)合我國行政法體系的特點(diǎn),通過多維度、否定式列舉,達(dá)到更加細(xì)致地界定私主體可參與的行政任務(wù)范圍的效果。私主體參與行政任務(wù)絕對不應(yīng)流于形式,否則該制度的引入將毫無價值,所以設(shè)計程序上和實(shí)體上的保障措施是能夠保證私主體有效參與的良法。在對私主體參與行政任務(wù)的監(jiān)督制度中,除了政府監(jiān)督和公民監(jiān)督以外,還提議設(shè)置獨(dú)立的、權(quán)威的監(jiān)督機(jī)構(gòu),其中政府監(jiān)督中提出了量化達(dá)標(biāo)方式,有利于促進(jìn)監(jiān)督的簡明和高效。私主體參與行政任務(wù)的規(guī)范雖然欠缺,但是并不能因此對其只重視管制和監(jiān)督,而放棄對它的保障,因?yàn)橐敫玫匕l(fā)揮該制度的作用,就必須真正尊重它,所以在私主體參與行政任務(wù)過程中引發(fā)爭議時不僅要保障第三人的權(quán)利救濟(jì),更要在私主體與行政機(jī)關(guān)產(chǎn)生糾紛時對私主體權(quán)利的救濟(jì)進(jìn)行保障,這有利于保護(hù)私主體參與行政任務(wù)的積極性,也有利于推動政府改進(jìn)社會管理的方式。根據(jù)執(zhí)行行政任務(wù)的私主體法律地位不同,產(chǎn)生爭議時對第三人的救濟(jì)途徑也不同,包括行政復(fù)議和行政訴訟以及民事法律規(guī)范的解決方式;根據(jù)執(zhí)行行政任務(wù)的私主體與行政機(jī)關(guān)的關(guān)系不同,產(chǎn)生爭議時對私主體的救濟(jì)方式也不同,包括復(fù)核、申訴與民事法律規(guī)范的解決途徑。
[Abstract]:At a time when the situation of private subjects participating in administrative tasks is widespread and developing and the system of traditional administrative regulations is weak, it is urgent to improve the regulation of administrative law in this field as soon as possible. From the perspective of administrative law. Combined with the reality of our country, on the basis of drawing lessons from foreign private subjects to participate in the implementation of administrative tasks, this paper analyzes and demonstrates the eclectic regulatory model that is more suitable for the legal system and practical requirements of our country, and based on this model. Will participate in the administrative tasks of the private subject status as authorized private subjects, entrusted private subjects, administrative assistants and pure private subjects. In defining the scope of private subjects to participate in administrative tasks. The author advocates to adopt the negative exclusion method, combining the characteristics of the administrative law system of our country, and enumerates the negative form through multiple dimensions. To achieve a more detailed definition of the scope of private subjects can participate in the scope of administrative tasks. Private participation in administrative tasks should not be mere form, otherwise, the introduction of the system will be of no value. Therefore, the design of procedural and substantive safeguards is a good law to ensure the effective participation of private subjects. In the supervision system of private subjects' participation in administrative tasks, in addition to government supervision and citizen supervision. It is also proposed to set up an independent, authoritative supervisory body, in which the government supervision puts forward a quantitative standard, which is conducive to promoting the simplicity and efficiency of supervision. However, it was not possible to give up its safeguards by focusing only on regulation and supervision, since it must be truly respected if the system was to play its role better. Therefore, in the process of private participation in administrative tasks, disputes arise not only to protect the third party's right relief, but also to protect the private subject's right relief when there is a dispute between the private subject and the administrative organ. This helps to protect the initiative of private subjects to participate in administrative tasks, but also to promote the government to improve the way of social management. According to the legal status of private subjects to carry out administrative tasks is different. When disputes arise, the remedies to the third party are also different, including administrative reconsideration and administrative litigation, as well as the settlement of civil legal norms; According to the different relationship between the private subject and the administrative organ, there are different ways of relief to the private subject when disputes arise, including review, appeal and settlement of civil legal norms.
