【摘要】：《實施動植物衛(wèi)生檢疫措施的協(xié)議》作為關(guān)貿(mào)總協(xié)定烏拉圭回合談判一個非常重要的成果，一直在國際貿(mào)易順利發(fā)展的進程中扮演著一個重要的角色，它也作為一項新的結(jié)構(gòu)形式出現(xiàn)在多邊貿(mào)易體制當(dāng)中。本文試圖從《SPS協(xié)議》產(chǎn)生的背景、內(nèi)容和宗旨闡釋其存在的必要性，對其在具體案件適用中所引發(fā)的問題進行分析，并結(jié)合我國目前的食品安全法制實施現(xiàn)狀分析我國目前存在的問題，而后提出相應(yīng)的對策。文章共分為四個部分。 第一部分對食品及食品安全的基本情況進行簡要概述。簡要闡述食品安全與國際貿(mào)易的關(guān)系，并且介紹國際貿(mào)易中調(diào)整食品安全的法律制度。第二部分從產(chǎn)生背景、主要內(nèi)容、指導(dǎo)原則等方面對《SPS協(xié)議》進行分析，并介紹《SPS協(xié)議》當(dāng)中與食品安全有關(guān)的規(guī)定。第三部分通過對我國食品安全法制現(xiàn)狀的分析，，來指出我國食品安全法制建設(shè)過程中存在的問題。第四部分主要針對我國食品安全法制建設(shè)過程中的不足和缺陷來介紹完善我國食品安全法制建設(shè)的對策以及建議。
[Abstract]:"The application of sanitary and Phytosanitary Measures Agreement" as the Uruguay round of GATT negotiations a very important achievement, has been in the smooth development of international trade in the process plays an important role, it also acts as a new structure form in the multilateral trading system. The thesis starts from the The first part makes a brief overview of the basic situation of food and food safety. The author briefly demonstrates the relationship between food safety and international trade, and introduces the legal system of food safety regulation in international trade. The second part from the background, main contents, analysis of the guiding principles, and introduced the and food safety related regulations. The third part through the analysis of the current situation of food safety legal system in our country, points out the existing process to China's food safety problems in the construction of legal system. The fourth part mainly focuses on the process of China's food safety legal system construction deficiencies and defects to improve China's food safety legal system construction and the countermeasures.
