【摘要】：器官移植作為一種現(xiàn)代先進(jìn)的醫(yī)學(xué)手段，在臨床實(shí)踐中廣泛應(yīng)用，給無數(shù)患者帶來了希望和幸福。隨著科技的全面高速發(fā)展，，器官移植無疑將進(jìn)入一個(gè)更加蓬勃發(fā)展的新時(shí)期，造福更多人類。然而器官移植技術(shù)在給人們帶來期望的同時(shí)也帶來了許多復(fù)雜的法律問題。法治國(guó)家的進(jìn)步，離不開與時(shí)俱進(jìn)的立法，通過立法對(duì)社會(huì)行為予以規(guī)范才能夠達(dá)到公平公正，達(dá)到社會(huì)穩(wěn)定和繁榮發(fā)展的意愿。近些年來，我國(guó)的器官移植事業(yè)蓬勃發(fā)展，在技術(shù)領(lǐng)域我國(guó)已經(jīng)躋身世界領(lǐng)先的行列，但在立法上卻處于落后的狀態(tài)，這對(duì)于我國(guó)法治社會(huì)的發(fā)展有一定的阻礙。為了解決這一難題，本文通過對(duì)器官移植現(xiàn)狀的了解，運(yùn)用比較分析法等方式，搜集了大量信息和數(shù)據(jù)資料，共分四個(gè)部分對(duì)完善我國(guó)器官移植法進(jìn)行了科學(xué)的分析，大膽的提出了幾點(diǎn)完善器官移植法的可行性舉措。 第一部分提出了器官移植法的概念，通過與其他部門法的比較分析了器官移植法的基本特征和器官移植法中的法律關(guān)系，詳細(xì)闡述了國(guó)內(nèi)外器官移植法的歷史發(fā)展和現(xiàn)狀。在第一部分的基礎(chǔ)上，本文第二部分從實(shí)踐的角度出發(fā)，指出了器官移植的廣泛應(yīng)用和其給社會(huì)帶來的諸多難題使完善器官移植法成為必要，同時(shí)，多種新類型犯罪行為的頻繁涌現(xiàn)，急需器官移植法的完善。第三部分歸納了我國(guó)現(xiàn)有器官移植領(lǐng)域相關(guān)立法的缺陷和不足，如觀念陳舊保守、沒有形成完整的法律體系、捐贈(zèng)門檻過高、缺乏死亡判斷標(biāo)準(zhǔn)等。再通過對(duì)域外相關(guān)立法制度予以總結(jié)，指出了幾點(diǎn)可采納的先進(jìn)經(jīng)驗(yàn)。第四部分則在前文的基礎(chǔ)之上進(jìn)行比較、分析和概括，對(duì)我國(guó)器官移植法的完善提出了幾點(diǎn)可行性的建議：建立全國(guó)統(tǒng)一的立法模式、確立器官移植法的基本原則、合理適當(dāng)?shù)臄U(kuò)大供體的范圍、確立專項(xiàng)法律制度、增加判斷人體死亡的法律標(biāo)準(zhǔn)和細(xì)化法律責(zé)任。 簡(jiǎn)而言之，本文從器官移植法的概念入手，對(duì)國(guó)內(nèi)外器官移植法的發(fā)展和現(xiàn)狀進(jìn)行了比較分析，再結(jié)合我國(guó)現(xiàn)實(shí)的具體國(guó)情，吸收國(guó)際上的先進(jìn)經(jīng)驗(yàn)，針對(duì)我國(guó)器官移植法中的不足之處，積極獻(xiàn)言獻(xiàn)策，希望我國(guó)的器官移植法能夠更加完善，對(duì)社會(huì)主義法治事業(yè)添磚加瓦。
[Abstract]:Organ transplantation as a modern and advanced medical means, widely used in clinical practice, has brought hope and happiness to countless patients. With the rapid development of science and technology. Organ transplantation will undoubtedly enter a new era of more vigorous development, benefit more people. However, organ transplantation technology not only brings people expectations, but also brings a lot of complex legal problems. Can not leave the legislation with the times, through legislation to regulate the social behavior to achieve fairness and justice, to achieve social stability and prosperity of the will. In recent years, organ transplantation in China is booming. In the field of technology, our country has been among the leading ranks in the world, but in the legislation is in a backward state, which has some obstacles to the development of our country's legal society. In order to solve this problem. This article through the understanding of the status of organ transplantation, by means of comparative analysis, collected a large number of information and data, a total of four parts to improve the method of organ transplantation in China for scientific analysis. Boldly put forward a few points to improve the feasibility of organ transplantation measures. In the first part, the concept of organ transplantation is put forward, and the basic characteristics of organ transplantation and the legal relationship in organ transplantation are analyzed by comparing with other departments. On the basis of the first part, the second part of this paper from the perspective of practice. It is pointed out that the extensive application of organ transplantation and the difficulties it brings to the society make it necessary to perfect the organ transplantation method, and at the same time, many new types of criminal behavior frequently emerge. The third part summarizes the defects and deficiencies of the relevant legislation in the field of organ transplantation in China, such as outdated ideas, not forming a complete legal system, too high a threshold of donation. This paper puts forward some feasible suggestions for the perfection of organ transplantation law in China: establishing a unified legislative model of the whole country, establishing the basic principles of organ transplantation law, expanding the scope of donor reasonably and appropriately, and establishing a special legal system.
