【摘要】:隨著城市的擴張與工業(yè)化的進程,在經(jīng)濟快速發(fā)展、土地價值提升的今天,我國的建設(shè)用地需求居高不下,現(xiàn)有的國有建設(shè)用地完全不能滿足城市建設(shè)和發(fā)展的需要。農(nóng)村集體經(jīng)營性建設(shè)用地入市流轉(zhuǎn)問題一直以來備受人們的關(guān)注,政府長期壟斷著土地一級市場,農(nóng)村土地要進入市場進行流轉(zhuǎn)必須先經(jīng)過國家的征收制度,將農(nóng)村的集體土地征收轉(zhuǎn)變?yōu)閲型恋睾蟛拍苓M入土地市場進行交易,長久以來,政府“低價”征收土地“高價”出讓土地以犧牲集體及農(nóng)民利益的賺取差價的做法倍受社會指責(zé),因此改變政府壟斷土地一級市場的呼聲日漸高漲。但我國現(xiàn)行法律法規(guī)限制甚至否定集體經(jīng)營性建設(shè)用地進入土地市場進行公開流轉(zhuǎn),在這種法律依據(jù)欠缺的背景下,部分集體及農(nóng)民在巨大的利益誘惑之下將農(nóng)村集體經(jīng)營性建設(shè)用地使用權(quán)進行轉(zhuǎn)讓,造成農(nóng)村土地非法隱形入市流轉(zhuǎn),土地市場的混亂。基于此,部分城市大膽地開展了集體經(jīng)營性建設(shè)用地入市流轉(zhuǎn)的改革探索,取得了重要進展和豐富的經(jīng)驗,這些改革試點的城市也相繼出臺了集體經(jīng)營性建設(shè)用地入市流轉(zhuǎn)的規(guī)定,為集體經(jīng)營性建設(shè)用地入市流轉(zhuǎn)提供政策導(dǎo)向,國家也在總結(jié)試點經(jīng)驗的基礎(chǔ)上推進改革,同時不斷探索農(nóng)村集體經(jīng)營性建設(shè)用地使用權(quán)流轉(zhuǎn)制度。集體經(jīng)營性建設(shè)用地入市流轉(zhuǎn)已勢在必行,其良好的運行關(guān)系著農(nóng)村的繁榮穩(wěn)定、農(nóng)民利益的保護、農(nóng)業(yè)的發(fā)展前景和統(tǒng)籌城鄉(xiāng)發(fā)展一體化的目標(biāo)的實現(xiàn)。黨的十七屆三中全會通過的《中共中央關(guān)于推進農(nóng)村改革發(fā)展若干重大問題的決定》(以下簡稱《決定1》)與黨的十八屆三中全會通過的《中共中央關(guān)于全面深化改革若干重大問題的決定》(以下簡稱《決定2》)對集體經(jīng)營性建設(shè)用地的入市流轉(zhuǎn)進行了宏觀的統(tǒng)領(lǐng)性的制度設(shè)計,但這項流轉(zhuǎn)制度的建立和運作是一項長期而系統(tǒng)的工程,其中仍然有很多問題亟待解決,僅僅依靠中央的政策來推進農(nóng)村集體經(jīng)營性建設(shè)用地流轉(zhuǎn)也仍然存在很多障礙。因此,在未來的土地市場交易中要構(gòu)建城鄉(xiāng)統(tǒng)一的建設(shè)用地市場,推進集體經(jīng)營性建設(shè)用地規(guī)范有序地入市流轉(zhuǎn),還需要進一步細(xì)化中央的頂層設(shè)計,明確具體操作辦法、流程,完善相關(guān)法律法規(guī)及配套制度,以實現(xiàn)農(nóng)村土地制度的順利改革。
[Abstract]:With the expansion of cities and the process of industrialization, with the rapid development of economy and the promotion of land value, the demand for construction land in China remains high. The existing state-owned construction land can not meet the needs of urban construction and development. The circulation of rural collective management construction land has been the focus of attention for a long time, the government monopolizes the land market for a long time. Rural land to enter the market for circulation must first go through the national expropriation system, rural collective land expropriation into state-owned land before entering the land market transactions, for a long time. The government's practice of expropriating land at a low price and selling land at a high price at the expense of the collective and peasant interests has been criticized by society. Therefore, the voice of changing the government monopoly land market is rising day by day. However, the current laws and regulations of our country restrict or even deny the collective management of construction land into the land market for public circulation. In this lack of legal basis, some collectives and farmers in the huge interests of the temptation to use the rural collective management of construction land transfer, resulting in the illegal circulation of rural land into the market. Land market chaos. Based on this, some cities boldly carried out the collective management of construction land into the market circulation reform exploration, has made important progress and rich experience. These reform pilot cities have also introduced the collective management of construction land into the market circulation regulations for collective construction land into the market to provide policy guidance. The country also on the basis of summing up the pilot experience to promote reform, at the same time constantly explore the transfer of rural collective operating construction land use rights system. Collective management construction land transfer into the market has become imperative. Its good operation is related to the prosperity and stability of rural areas, the protection of farmers' interests. Prospects for agricultural development and realization of the goal of integrating urban and rural development.
