【摘要】：冷凍受精胚胎作為新興的事物,挑戰(zhàn)了人們對(duì)傳統(tǒng)理論法學(xué)的認(rèn)識(shí),現(xiàn)在人們對(duì)其認(rèn)識(shí)還不是很全面,對(duì)冷凍受精胚胎問題的處理更是處于摸索階段。冷凍受精胚胎的屬性決定了這是一個(gè)復(fù)雜的過程,現(xiàn)在學(xué)術(shù)界對(duì)其法律屬性認(rèn)定的主流觀點(diǎn)是“主體說”“客體說”“折中說”。本文在認(rèn)可“客體說”的基礎(chǔ)上,將冷凍受精胚胎認(rèn)定為夫妻不可分割的共同共有物。由于冷凍受精胚胎一般是在夫妻關(guān)系存續(xù)期間形成的,夫妻離異無形中又會(huì)加大了對(duì)其處置的難度。夫妻離異時(shí)冷凍受精胚胎能否繼續(xù)孕育、保存、贈(zèng)與、銷毀都是面臨著的問題。針對(duì)夫妻在進(jìn)行輔助生殖手術(shù)之前訂立的協(xié)議是否具有最終性都值得考量。同時(shí),夫妻離異又會(huì)出現(xiàn)很多的被“遺忘”的冷凍受精胚胎,對(duì)于這些冷凍受精胚胎醫(yī)療機(jī)構(gòu)是否具有處置權(quán)也值得商榷。如何讓冷凍受精胚胎在夫妻離異時(shí)受到妥善的處置,兼顧法理與情理,讓冷凍受精胚胎得到充分利用,使夫妻雙方都達(dá)到接受的程度是本文的核心所在。本文首先通過結(jié)合典型案例提出目前夫妻離異時(shí)處置冷凍受精胚胎所面臨的問題,再通過對(duì)冷凍受精胚胎的屬性、夫妻間的合意、法理與情理的考量以及對(duì)冷凍受精胚胎監(jiān)管的不嚴(yán)密這幾個(gè)方面進(jìn)行分析,找出夫妻離異冷凍受精胚胎處置遇到問題的原因,針對(duì)出現(xiàn)這些問題的原因,參考國外司法實(shí)踐中的典型案例與立法、結(jié)合我國實(shí)際情況,提出在我國現(xiàn)有規(guī)章的基礎(chǔ)上通過完善立法、尊重當(dāng)事人意思自治的情況下尋求法理與情理的平衡,以此來完善我國在夫妻離異時(shí)如何處置冷凍受精胚胎的建議,以求在未來的司法實(shí)踐中為解決這類問題提供一些參考。
[Abstract]:As a new thing, frozen fertilized embryo has challenged people's understanding of traditional theoretical jurisprudence, but it is still not fully understood. The treatment of frozen fertilized embryos is in the groping stage. The nature of frozen fertilized embryos determines that this is a complex process. At present, the mainstream view of the legal attribute of the academic circles is "subject theory", "object theory" and "compromise theory". This paper is based on the recognition of "object theory". The frozen fertilized embryo is recognized as a common and indivisible common property of the couple. Since the frozen fertilized embryo is generally formed during the marriage relationship. Divorce of husband and wife will increase the difficulty of its disposal. When the husband and wife divorce frozen fertilized embryos can continue to conceive, preserve, gift. Destruction is a problem. It is worth considering whether the agreement made between couples before performing assisted reproductive surgery is final. Divorced couples will see many "forgotten" frozen fertilized embryos. It is also open to question whether these medical institutions have the right to dispose of frozen fertilized embryos. How to allow frozen fertilized embryos to be properly disposed of in the event of divorce, both legal and reasonable. To allow frozen fertilized embryos to be fully utilized. The core of this paper is to make both husband and wife reach the level of acceptance. First of all, through the combination of typical cases, this paper puts forward the problems faced by couples in disposing of frozen fertilized embryos when they are divorced. Then through the frozen fertilized embryo attributes, the agreement between husband and wife, the consideration of legal theory and reason, as well as the frozen fertilization embryo supervision of these aspects are not strict. To find out the reasons for the problems in the treatment of divorced frozen fertilized embryos, referring to the typical cases and legislation in foreign judicial practice, combined with the actual situation in our country. On the basis of the existing rules and regulations of our country, the author proposes to seek the balance between law and reason by perfecting legislation and respecting the autonomy of the parties. In order to provide some reference for solving this kind of problems in the judicial practice in the future, the suggestions on how to deal with frozen fertilized embryos during divorce in our country can be perfected.
