【摘要】：食品安全領(lǐng)域運(yùn)用"黑名單"的手段越來越多,適用情況也很復(fù)雜。根據(jù)各地規(guī)定、做法的不同,"黑名單"的性質(zhì)也有所不同。對(duì)于其性質(zhì)認(rèn)定,學(xué)界目前并沒有達(dá)成一致,主要是傳統(tǒng)行政法視角下的行政處罰說、行政強(qiáng)制說、信息公開說、行政指導(dǎo)說、行政事實(shí)行為說。面對(duì)這種新型的政府規(guī)制手段,不妨跳出傳統(tǒng)行政法的束縛,轉(zhuǎn)而通過行政過程論的分析方法,在政府規(guī)制理論視角下對(duì)其進(jìn)行重新的認(rèn)知與定性。理想的認(rèn)知模式是:企業(yè)存在特定的不良記錄-納入"黑名單"-公布-禁止,是整個(gè)信息規(guī)制鏈的概括。
[Abstract]:The field of food safety using "means more and more black list", for the situation is very complicated. According to the regulations, practice the different nature of "black list" is also different. For the determination of the nature of science, there is no consensus, mainly is the traditional administrative law as the angle of administrative punishment, administrative mandatory information disclosure, said, administrative guidance, administrative fact behavior. In the face of this new means of government regulation, might jumped out of the shackles of traditional administrative law, and through the analysis method of administrative process theory, cognitive and qualitative re on the theory of government regulation. Under the perspective of idealized cognitive models is: enterprise there is a specific record - incorporated into the "black list" - released - is prohibited, the entire information chain regulation are summarized.
