【摘要】：黑車已成為城市治理頑癥,取證環(huán)節(jié)尤為困難,集中體現(xiàn)在:"隨機引誘式"、"重點引誘式"等誘惑性秘密取證方式是否屬于國家不當(dāng)挑唆公民違法,能否避免誤抓順風(fēng)車;公共場所的"視頻巡邏"、暗中"錄音攝像取證"等非誘惑性秘密取證方式是否侵犯公民的隱私權(quán)與人格尊嚴(yán)?《上海市查處車輛非法客運辦法》的實踐表明,解決取證難的對策應(yīng)當(dāng)是:慎用乃至禁止隨機引誘式便衣取證;重點引誘式便衣取證應(yīng)增加"搭載行為超過兩次以上"作為適用前提,并加強調(diào)查主體的中立性;非官方組織、個人雖可輔助行政機關(guān)進行公共場所監(jiān)視,但是禁止其全面監(jiān)視、追蹤監(jiān)視、使用非常規(guī)監(jiān)視器;行政機關(guān)設(shè)置公共場所監(jiān)視器應(yīng)當(dāng)遵守透明性原則;暗中"錄音攝像取證"要遵循相關(guān)性原則;令狀原則;合法處置錄音、錄像資料的原則;監(jiān)督執(zhí)法原則。
[Abstract]:Black car has become a stubborn disease of urban governance, especially difficult to obtain evidence, concentrated in: "random luring", "key seduction" and other enticing secret evidence whether the state instigates citizens to break the law. Can avoid catching the windmill by mistake; "Video patrol" in public places, secretly "recording camera evidence" and other non-enticing secret methods of evidence whether it infringes citizens' privacy and human dignity? The practice of investigating and dealing with illegal passenger transport of vehicles in Shanghai shows that the countermeasures to solve the difficulty of obtaining evidence should be: careful use or even prohibition of random inducement of evidence taking in plain clothes; The key luring type plainclothes evidence should increase "carry on the behavior more than two times" as the applicable premise, and strengthen the neutrality of the main body of investigation; Non-official organizations, individuals may assist administrative organs in public surveillance, but prohibit their overall surveillance, tracking surveillance, the use of unconventional monitors; Administrative organs shall observe the principle of transparency in setting up public place monitors; Secretly "recording camera evidence" should follow the principle of relevance; Writ principle; Principles for the lawful disposal of audio and video recording materials; Supervision of law enforcement principles.
